Are you EB2 or EB1?

granstagna,

Congratulations on your approval. Are you EB1 or EB2? If so then it appears that TSC is approving EB1, EB2 cases along with 02 and early 03 EB3 cases with RFEs. It might all be speculation.

Lets see what happens next.

Mine was EB3. Last week I did call TSC on their direct# to check on the status of the RFE response,and the lady said it'll probably take another month or so. Next thing I know, it was approved. Don't know if thats just coincidence or what.

There is no update on my side. I was on vacation and was hoping to see some status change upon my return. Nothing has changed. I am now approaching 2 months since ACK by TSC.

The other thing is that mine and my wifes APs that were filed in Jan 05 are still pending. I put in a phone inquiry and received a standard letter stating that the supervisior has been notified. No news after that. Our APs are now 3 months behind the published TSC date. I am hoping they are holding of on approving the APs because they will just approve the 485s but this might be very optimistic thinking.

I have updated some of the information on the excel sheet. Check it out. There seems to be no movement on RFEs.

I am quite surprized to see that your AP is pending since Jan 05. Recently, we filed our AP and it got approved in 28 days. You need to call them and ask for the cause.
And, on 6/9, I will be completing 3 months, since they received my reply to RFE.

Use 800 cust call/status check on phone, after listenting status,

use option have questions/multiple petition that connect to TSC direct, almost all cases lady replies by saying 'TSC'.

APs

Banglababu and others,

If you check my signature you will realize that absolutely nothing has been straight forward in my case. My 140/485 has been transferred to the wrong office, recalled by TSC, the 140 has taken almost a year for approval, my 2nd EAD application has been transferred to the wrong office and then recalled by TSC and approved, my wifes case has received a RFE, she has gotten two FP notices and done FP twice in the span of 2 months and finally there is no news on the AP after having filed them in Jan 05. So I am not surprised by anything that happens to my case.

I am just patiently waiting for them to goof up once again and approve my case :). This process has been and continues to be a total nightmare that refuses to end.

Anyway, thanks for the TSC number. I will call and see what is going on with my wifes 485.

Dear SARAS76

I am also going to call TSC and find out what'z going on with my Case.I called today on the general number and they said, it would take 3 months as TSC is processing these days April 2003. I am sure, they know nothing. I am more interested talking to someone in TSC.

Also, June 05 I am going to India for 2 months. Also, I wanted to know, if there is any max day limit before one needs to get Passport stamped, after the 485 is approved. My worry is, if we go for stamping after say 2 months, will I be viilating rules. And I am gessing, re-entry to USA on AP, is not an issue

Travel on AP

Banglababu,

We just travelled out of the country and my wife used her AP for re-entry. There were no problems. The officer did ask her stupid questions like "How did she come in possesion of the document"? We felt like saying that we found it lieing on the floor in the airport :). Anyway she explained that she got it through my GC process. She was taken into a separate room where they looked at her paperwork. After looking over my wifes AP and escorting her to the special area this guy turned to my paperwork. I still have a valid H1B visa and do not use AP while travelling. The immigration officer did not know the rules and asked me where my AP was and why I was not using it to travel. I told him that I have an AP but I still have a valid H1B and do not wish to use my AP for travel. He went somewhere to verify and admitted that I seem to know the process more than him and let me through to join my wife in the waiting room. I went to the waiting room where we wasted about half an hour and then they gave my wifes AP and passport back.

As for a time limit on PP stamping. I would post this question separately on the 485 forum. I am sure someone will have an answer.

I tried to call but i can't get through, as soon as i enter my SRC #, there's that famous error in the database that cannot find my account,so i can't listen to my status. Any workaround? I wonder if i can try the change of address option, think they will be pissed if i am not really changing my address? :confused: :confused:

I had similar system error too, than I used my EAD receipt :D . when connected I gave them 485 src :D :D

use any receipt# even old

You might be approved soon. A friend of mine had similar situation with AP.
It took longer than it should and then it was just denied because along came her 485 approval!
I renew my AP last year and it took only 25 days, so I hope is your approval coming...

Thanks for the encouragement but I am not counting on anything at this point. I will only believe it to be truly done once I have the written notice of approval in my hand and a stamp on my passport.

Interesting turn of events

Maybe this will give you some hope. I got approved after 3 working days of acknowledging RFE (legal status). I think this was super fast. I wonder why.

Here are my details.

PD 6/2001
140 AD March, 2002
485 ND June, 2004
RFE issued 5/16/05 (legal status -- officer #365)
RFE received 5/20/05
RFE replied 5/23/05
RFE Akw 5/25/05
LUD changed every day since akw including memorial day holiday!
485 AD 5/31/05
 
EB3s

Guys,

It appears that TSC is not processing to many late 03 and 04 485s (EB3) lately. They are applying this to RFE cases as well. There have been a few expections to the rule but in general approvals only seem to be for 02 and early 03s for EB3s. I guess there is no telling how long the wait might be for EB3s from late 03 and all of 04. Anyway I have updated the sheet and am attaching it to this post.

It seems they are pretty much determined that they wont approve my Case, in a near future!! My recently submitted AP got approved in less than one month and today, my 3rd EAD got approved in 10 days. So, it seems, someone is determined to sit tight on my pending 485 and not willing to approve....!!!

And, MR JANGLI, Oh! I mean Jangal, What exactly you meant by saying EB2 people not updating Main Page??
