2nd Interview but not completed the case yet

Yes, I have spoken to a second person when I called 1800 number. The first person was transfering to the second person and I am not sure he is the right person we are talking about. He asked me about the second interview that he has on his system. He said to wait 30 more days to get the service request to get at the DO that will be second week of October. So, best thing thing is make a INFO after the 30 days of my call?

I have called the 1800 number and they said the case is on additional review. Anyway I have an apointment on next Fri. I hope everything will be fine. They need 6 more month for the review, the officer said when I called.

Marlia,
why wait for 30 more days when you waited 5 long months,I would go for infopass to follow up
can you please share where your DO is?thanks

The officer is telling you nonsense. The law requires them to make a decision within 120 days since the first interview, and you are already past that. File a 1447(b) lawsuit if your Friday appointment does not produce some progress. When at the appointment, remind them that it is already more than 120 days.

When I called the officer told I have to wait 6 more month to get a decision that start from Sept, 2009. They don't concider that I have already waited 6 month from my first interview in April. The 2nd interview was after 5 month of first one.
From reading all post here I am afraid to tell you even which office I am dealing with. I'm afraid they are looking for a reason to deny my case, I am afrid that sending a comlaint letter will make the IO angry toward me. Moreover, my husband also says to wait and not to follow up because they have to make a decision, we did everythingh we could, we can not speed them up for the work they have to do.
Totally fustrated. I am having a wonderful life with my husband and he does not want anything happen to me.

If there is nothing you can do, then I suggest you forget about this for teh time being and just wait. In themeantime, just live as a PR

Yes, Bobysmith. I got the paper saying that I have passed the English and History but "a decision could not be made"
I got that on April.

Sorry, I just reread the posts and saw you already mentioned that previously.

If you can't afford a lawsuit right now, at least consider contacting the USCIS ombudsman's office immediately to open an inquiry into your case. Also, you should contact your congressperson's office to ask them to inquire on your behalf as well.

congressman/senator/white house

My case has been delayed (it was while ago) and I started to write letters to
Senators of my State, US Congress Representative from my district, and also to First Lady.
You can find contact information in the Web. (you even can call/visit
Representative/Senators offices).
Usually they are forwarding your letter to USCIS and adding their own request
to look into your case. All these worked for me.

OK, time to write something about my case. I have been keeping in touch with USCIS by calling 1800 and last month the person transfered me to a IO who was very nice. He made a sevice . I made INFOPASS appointments several times. Sometimes the officer made me to write a service request and an another time the officer said after sept 11 they need an extra backround check-up and said I have GC to travel why I need citizenship. It has been a year after the interview. I asked the officer when would hear a decision, do I have to make an another INFOPASS, he said I can go there every day. So, I went there again the next day. This time I got an another nice lady officer. She looked into the computer and said my file moved into a juridicator's table last week and he would make a decision soon. My FP is expiring today. I told that to the officer. She said they will send me an another FP appointment letter or oath letter. I made a service request again, she took copy of the interview result and said she was going to give this to the juridicator(whatever it is). The bottom line is I am still waiting.

Thank you Boby, you are so sweet to respond for my post so quickly.
Would you pls tell me, have you ever heard anything about 2nd FP appointment? and the outcome?

If Marlia filed 1447(b) last year she would probably be a citizen by now.

If she does not file it this year, she probably will still be waiting next year.

I wouldn't worry about 2nd FP at this point since your case is already being looked at by an adjudicator (immigration officer). Have you contacted the USCIS Ombudsman's office, your congressperson or considered filing a lawsuit?

This is a prime case for a lawsuit, assuming that Maria has not omitted any material fact which could justify the delay in her case. I would send a formal overnight letter to the district director and the head of the naturalization unit telling them that unless they adjudicate the case within x number of days a lawsuit will be filed.

Congres gave us the right to use for a reason and use it to your advantage.

You guys are well educated and write in good English. I still have problem with my language. That's why I did not file a lawsuit. Moreover, I don't have money to approach a lawyer. Let's see what will happen during the coming 30 days, then I start contacting important people like you guys do.
