245(i) ANY NEWS OUT THERE?

I'M A USC, my spouse's I-130 is approved. We married in 2004. He entered without inspection back in 1994. Has no criminal background and has paid taxes since he applied for the TPS for Honduras nationals. He has not left the U.S. since entering. I have not submitted the adjustment since I'm nervous that he will have to leave. We have a 4 year old girl and I can't see myself without him if he is ordered to leave the U.S. I've been told that he can get a waiver? How true is this? I've been waiting for the 245(i) these few years and I am not sure if there's anything out there. :(
 
You should explain the part "waiting for 245(i)".
If you are the sponsor, your family relationship must have existed as of April 2001 to be qualified to 245(i).
 
Thank you for the replies, I'm definitely not under the 245i since we did not even know each other back then. Does anyone know if I should go ahead and try to risk it and submit the adjustment and hope to get a waiver?
 
You do not just "hope" to get a waiver... you have to apply for one. Better consult a competent lawyer, than risking $ 1,010 for a denied AOS.
 
I'm going to consult with an Attorney soon, I've been referred to an atty by the name of Nancy Falgout in Houston, Texas. I called her office today and I was told to call back on Friday, since that's the day she schedules the appointments for September, 2007. I'll keep you posted. Thank you again.
