Do I or my employer need to complete any formality as I will be transiting from H1B to EAD ???
--I think you have to update work status on I-9 or w-9 form.

What about the I-94 attached to me visa ? It is also expiring on May-23.
--Shoudn't need to worry about that. Just save it for latest I-94 entry record.

Thanks LaborBadhi.

CONGRATS SPIDEY !!! I hope you keep visiting us and provide your inputs .

question on going to India on AP

Congrats spidey, finally the whole headache got over.
Coming to my questions-
I have a H1 until apr 2007. But I have no visa as of now. I have AP from my spouse's GC. I am planning to go to India for 4 months. Do u guys think I need to go through the visa thing or can just use AP and come back without any hassles. As of now our 140 is in a RFE state
One more question- Attorney said he sent a response to INS on wednesday last week by overnight. Until now the online status does not show that the response is received. How long does it take to show up online once the response is really received ?

I-140 Approved

I got an email, after nearly 4 months, my I-140 is approved. Waiting to apply for I-485. Can someone please advise me, should I do consular processing, once I'm not retrogressed anymore, it just seems it would take a lot less time (couple of months vs. one year) or do I-485? I know there are some benefits of doing I-485 (EAD, for example) but I'd like to know why some of you guys opted for I-485 vs. consular processing?

Thanks a million
