Dear All,

Just received multiple emails for the approvals of all family AOS.

Overall history:

(1) Working in big Pharma, New Jersey. Scientist from non-retrogressed country. All processing done by big Lawyers firm hired by employer.

(2) Labor Cert. (Reduction in Recuitment) filed in March 2002. Pending as of May 2005.

(3) I-140 as Outstanding Researcher filed April 4th, 2005, together with AOS and AP/EAD.

(4) AP/EAD approved in three weeks - April, 27th 2005.

(5) FP/Biometrics taken for me and spouse in Newark - May 18th, 2005.

(6) No LUDs after May 19th, 2005.

(7) I-140 approved - October 16th, 2005.

(8) RFE on AOS, asking about the waiver for the two-year foreign residence - which I was not required to (shouldn't they know that already, since I have been an H1-B for more than 5 years??). RFE received November 22nd, 2005.

(9) Response to RFE recieved by USCIS on Dec 18th, 2005.

(10) AP/EAD renewal received by USCIS on January 13th, 2006.

(11) AOS approval e-mails received today - January 20th, 2006.

What a relief...

Awaiting the upcoming notices to change to ...cards ordered...cards mailed...

For those that believe in the conspiracy theories, (10) may have triggered (11) - after they cashed the $$ for (10) they do not have to actually do anything since AOS is done... I personally believe more on the second Law of Thermodynamics.

For the above cited believers in the conspiracy theory, I was promoted on Wednesday, with a 15% increase in my salary!

140 Rfe received Status

Congrats to all who got their 140 cleared and specially to those with 485.

Just checking if someone can tell me after a RFE response is sent by lawyer, usually after how many days can i expect it to update on the USCIS web site saying RFE received.

LUD Changed - What does it means???

Hi, Does any one have an idea of what happens after LUD has changed. In my case for I140 here is the data of LUDs

LUD#1 11/08/2005 - Message - Your case received on Nov 3 and it takes 90-485 days to process.

LUD#2 01/30/2006 - Message - Your case received on Nov 3 and it takes 90-485 days to process.

Does any one know why the message did not change with the change in the LUD?

Today my I-140 was approved and I am in long queue for I-485.

Followup :
I just noticed that my 140 has been approved. The message changed a few hours after the change in LUD.

When you register you would see the following columns:
Receipt Number - your EAC#
E-mail : Flag to receive notification upon any changes in ur case
Last Updated (mm/dd/yyyy) : this is LUD
Form # - like I-140, 485 etc...
Form Title - name of the case..

I-140 Approved - wow

Got an email last week saying my I-140 has been approved. Wasn't really expecting it as most of the 140 approvals were coming on the BEC cases with older priority dates (mine is a PERM case).

One more step done... now the long wait for I-485 starts.
Who knows... probably there will be an AC21 before that :)

Hi das_go

Normally within 60 days you should receive some answer. If it has passed 60 days then u better contact service center right away.

any apporvals for 140 from month of May and june recently ?

When you register you would see the following columns:

AC-21 Questions

If my I-140 is approved and I complete 6 months after application of 485:

Can I use AC-21 to change companies if

1. If my company closes down ?

2. If I am laid off ?

3. If my company merges or is taken over by another company?

In short, How Safe am I ?

You are completely safe.
The only thing you need to be careful of, your next job should be in same or similar job classification as your original labor certification.
Geography doesnt matter.
Same and Similar can be interpreted loosely or very strictly depending on officer adjudicating, so be safe and look up your job code for allowed titles and duties.

What about the pay can that be higher than the one quoted in labor stated doc ... if so how highter can that be ?

Well my l*w*er sucks, he always B*S*. He told me that he has submitted the Rfe response but i doubt. So just wanted to know if lawyers sends the response then when(approx how many days) does it say on the web site that they have received RFE response. Thats't it not when they will adjucate .

Now as i understood noramally in 30 to 60 days u should see some LUD on ur case.
