Your question is a bit confusing. However this should answer your query:

You cannot apply for 485 and EAD without applying for 140 alongwith your 485 application. However, if you have a 140 approved (and had not applied for 485 and its interim benefits like EAD and AP), you can apply for them now with a copy of your 140 approval. Hope this helps.

I got a mail today about 140 RFE. For 140 after LUD on Mar 18, 21 and 22 finaly I got the mail below.
"On March 28, 2005, we mailed a notice requesting additional evidence or information in this case." :confused:
No change in 485 LUD, received EAD card today.

I have Done FP&Biometrics today 3/28/05. They have taken fingerprints of all fingers, picture and signature. It takes 10 minute to get the process done.
but no LUD after FP :mad:
 
Miliky--> if your case is following mine, then you should get your AP/EAD approved within one week of fp. You will get first LUD change for 485 tonight.

Question

My labor was approved on 31 March 2005
The date it was sent to NJ DOL was April 2 , 2002

My lawyer says that the current dates for India is April 1 , 2002 to file concurrently 140 and 485 as of today
He is advising me to wait for a few more days to apply both of them together .

Do you think this is a good call or I should file for my 140

Pls advise

Finger prints result received

Received email from USCIS. Finger prints results have been received for both me and my wife. Do not expect them to process my case soon.

The way things are moving, mostly likely you can file it concurrently by April-end if PD moves ahead which it should, looking at the trend. Of course, the next visa bulletin wont come out till mid april and it wont be effective till 1st May.

So all you need to consider is if a one month delay in filing 140 is crucial for you...in case you are hoping to use AC21 sometime in the future.

As far as I know, the only benefit of filing all the paperwork together is saving on fedex cost. Anybody knows better?
 
Any comment / prediction on my constant 140 LUD change?

140 RD 3/7/05, ND 3/12/05, LUD 3/17/05, 3/29/05, 3/30/05.
485/EAD filing date 3/18/05, ND ???

Got an RFE on ability to Pay. Most probably i am totally screwed. time to drink more :(

ACDC, I have also a RFE on 140 but letter mailed by uscis on Mar 28th. Do not know when attorney will get that and what they are asking. BTW after how many days your attorney/company received RFE ? You may take help of UnitedNations if your company does not help you. good luck.

Hi
Finally after some arm twisting i got the RFE, it asks about company finances and my employment proof with the company till this point. I had to throw a few tantrums to get the details out.

I have asked United Nation for help and he has as usual been the best guide on this matter.

I am out of touch with the current state of affairs.Need some help from you all to get me up to speed
If a pre-approved labor (EB3 / VSC) has a PD of Dec 2002, can I apply for I140 and 485 right away concurrently OR do I have to just apply for I140 and apply I1485 later ? My country of Citizenship is India.
 
Not right now...you will have to wait to file 485/AP/EAD until your dates become current which at the current rate could take about 8-9 months (for Dec 2002 PD).

However, if you are married and your spouse is a citizen of any country except Ch/Ph/India OR if your spouse was born elsewhere, you should be eligible to file 485 immediately.
