140 must be filed the same day with 485 ?

Hi friendes,

I am quite new to here as my LC just approved in Feb. With the aid of my lawyer, I just sent out my 140 last week. But my lawyer said that it is not necessary to file 485 on the exact day with 140, but still belong to the catgory of "concurrent". She also told me that as 140 & 485 were not sent out at the same day, I can't send out 485 until i receive the notice number of my 140. We were also informed to do the medical test during the period before getting 140 notice #. As i see many friends here only have one date for their concurrent date, so anybody here can help me verify this point and let me know if medical check can be done some time after 485 submission (as i am in an urgent status of expecting my spouse's EAD and really hope 485 could be submitted ASAP).

As far I know, need to submit Medical Report along with 485. Also 140 and 485 can be filed on same day or different days. In the current scenario If Priority Date is current both 140 and 485 can be filed on same day.

You can ONLY apply for a 485 if the 485 priority date is current. Priority date is the date when your labor was filed with the state SESA. If you are EB2 then nothing to worry as EB2 dates are current for all countries. If you are EB3 and belong to a retrogressed country (India, China, Philliphines) and your PD is not current (I think the current PD for EB3 of retrogressed countries is March 2002)...you cannot file your 485 at this time. If you fall in this category, you will have to wait till the 485 dates become current.

Tell me what your labor is EB2 or EB3 and when it was filed and I can tell you if you are affected by retrogression or not.

Any body got the similar message? If so what this indicates

If you are EB2,then nothing to worry. You are not affected by Visa Retrogression.

140 approved

Hi, guys,

my 140 has been approved. I have also received FP notices for both my wife and myself. The appointment is on 04/09/05 in Philly. Seeing so many people got turned down for their early FP in Philly, I have decided not to go for early FP.

Congratulation. :) Not sure when they will work on EB3 cases. :(

140 LUD stuck on 03/03 no updates. Anyone anyone what's going on here. How much time does RFE dispatch take, how much time does Denial dispatch take?
