it might. Coz u wont find many ppl waiting to file for AOS(485) with PD date less then dec 2003.

So chances r they might just move ahead without ppl getting any approval on their cases :)

Even my case is like yours. I work for an employer A on H1B but now I have a I-140 approved for employer B. As per discussion with lawyer I'm moving to join employer B on EAD to better my case for any future RFE's for my future employment case, but this is not necessary.
Once you or your family use EAD/AP then that person's H1B status is gone so I think that if you use your AP to enter US, then you hve to work with employer A on EAD instead of H1B.

Has any body called VSC reg 485 approval? Could please some body paste the phone details for calling VSC reg 485. Couldn't find the details in earlier postings ..I think I can call since my I-140 has already been approved.

Hi GS71,

Did you try taking and infopass appointment. You can meet with an immigration officer and get details. Your PD is 07/2000 which means that you are not retrogressed. Maybe you are stuck in the FBI Name Check. I think the best way to get more information is using Infopass.

I called them, they opend enquiry, I should here in 3 to 4 weeks. BTW what year you filed your 485, they are processing cases received before Dec04.

What is the possibility on this approval?

Thanks ! Guess your reference of Dec04 is from 'VSC 485 processing time', however my understanding is that these dates only apply to non-retrogressed countries. Looking at your signature, your PD became current in last 2 months only (if you r from retrogressed country), so there may be some other criteria. Mine concurrent filing was done on 07/23/05. Pls update us once you hear back reg your query.

i140 - AP: 11/10/2005
485 : AP ? (couple of LUD after my 140 approval, last LUD was 11/29/2005)

LUD Change

There was a change in LUD for both me and my spouse for our I 485. Our PD is Aug 1999.

I think they have certainly started processing your application as you moved out of retrogression in February. They might have assigned a visa number for your case. Hope we hear some good news soon.

Hi Gurus,

One quick question Can I get H1 extension for 8th year if I have the labor certification approved and has passed more than 365 days since the filing of labor cert and the I140 is filed but pending for less than 365 days? Any help will be greatly appreciated
