I was originally talking about a long debate with UN in one of the threads that I can't find now. Briefly, UN was asserting that the cases filed under 245(i) were mostly put under EB3 category, for the lack of any other. Then UN was saying that if approximately 300,000 LC's were filed under 245(i) in April 2001, and let's say half of them would be approved, then 150K would file I485, plus their kids and wives, so this may be 450k. Now if only 40K of immigrant visas are alocated to eb3 anually, then you get 450/40 = 11 years is when all of them get processed. So if my PD is April 30, 2001, my case would be processed somewhere between now and 11 years later, according to a uniform distribution. SO I'm shiit out of luck.

I went to double check this again and I found this thread: http://boards.immigrationportal.com/showthread.php?t=204516
which brings a complete relief, saying that EB3 pool was not affected by 245(i). So I hope this is right. But I am not sure whom to believe here. I probably missed a lot of development in this debate. I am sorry if I disturbed you with my original paranoya, in my last post. What do you know about all this?

I believe that each 245i case falls to EB3 skilled workers category but not to EB3 other worker. The condition of EB3 skilled worker is bachelor degree OR 2 years of work experiense which requires special training. It is easy for 245i to prove that their job of cook, carpenter, plumber, roofing specialist etc. requires 2 years of special training.

There are 2 problems for 245i which can happen on I-140 stage.

1. I believe each 245i case will get RFE to proove an ability to pay. It will be really hard for them to prove it. Because many of them filed applications from companies which have annual revenue ~10-15K.

2. Most of them came from the south. There is a quota limit for each country per year.

The General problem for EB3 skilled workers is that USCIS holds visas, and retrogression date was set not by analysis or calculation, but simply used the last day of filing 245i. When new year for EB3 visas begins October 2006, there will be a lot of unused EB3 visas, they can not be rolled over to the next year automatically without congress approval. Congress can vote to give those unused EB3 visas from 2006 to some other category (Eb3 nurses, Eb4 or Eb5 ) in 2007, like they did in May 2005 when 50K EB visas were given to nurses.

1. Congratulations, GCprocess! How long was the I140 pending?

2. A queer thing happened tp me today. I called SIC at (800) 375 – 5283 to inquire on my i485 status. I dialed this sequense in the menue: 1-2-6-1-3-3-1. After waiting awhile a guy answered the call asking "why I was transfered for further assistance?" :confused: I replied saying that I was not transferred. He asked me about my case and actually looked into it. I mean, he did not sound like an answering machine. While I was on the phone with him he typed a 2 page memo that he called a "referral" on my case asking to finish it and sent it to VSC via email. He also gave me a referral number that I could use 30 days from now. He said that they will schedule another finger print appointment for me and there will be another FBI check :( , since fingers are only valid for 15 months. So at least something is moving, even though it's sort of moving back to the finger prints again. Can anybody comment on this?

What are your thoughts? Is it delayed because of security or ...is it generic message.

GC Approved

I am glad to say that GC application has been finally approved. I received the emails from the USCIS website this morning and I am guessing that it will still be a few weeks before I get my actual GC card.

it has been a somewhat long process taking 3.5 yrs. I know that there are many applicants who are waiting for a much longer time. Good luck to you all.

It appears to me that USCIS is moving pretty quickly and approving pending applications once the visa numbers are available. My case was out of backlog on May-1 and my case was approved on May-6.

Should I get an Infopass appt. to have a stamp on my passport or simply wait for GC to show up in the mail?

If you had FP code 3, then you do not need a PP stamp, you will get cards directly. Otherwise you will have to go for PP stamp. Your online status will also show "..card ordered.." in a day or 2 if you are getting card diretly.

Yes, I did complete FP with Biometrics last year (April '04). I will just wait for a few days to see if I get the Card Ordered/Mailed message.
