I just logged in to my email to find the much awaited email from USCIS about my I-485 approval !!

My husband's I-485 is still not approved. (I am the primary applicant).

Regarding EB3 RETROGRESS" process

This is the feed back i got from my Attorney:
------------------------------------------------------
Your I-140 petition will continue to be processed according to
the Vermont Service Center processing even though 3rd preference has
retrogressed. The Immigration Services will not be able to adjudicate
(review files) the I-140 and I-485 concurrently as originally planned. If
I-140 petition is approved, then they will continue with I-485 adjudication,
and will only approve if the priority date is current for you. I cannot
tell whether your I-485 approval will be delayed because of retrogression
since I-485 usually takes a couple of years for approval anyway. By that
time I am sure the 3rd preference would have advanced beyond your priority
date.

Question on EAD

Hi Gurus,

If one files I140/485/EAD before January 2005, using EB3 with PD 12/2003,
will the EAD for the spouse gets processed and approved ? Or the person
has to wait until the PD becomes current to get the EAD
processed/approved?

Any information or comments really apreciated!!

VHD999,
EAD/AP processing won't be affected by EB3 PD retrogression. you should get your EAD's approved very soon......
