I dont think FOM memo is being applied in Vermont.

Mine was a EB3 concurrent filling on June 16, 2004. I 140 approved yesterday Oct 4th 2004 but no LUD on 485..I think the FOM memo is only theorotical...in my opinon

You have observed a good point. There are many other cases like me who had concurrent filings after April but only the I-140/EAD/AP are approved. There is no LUD on i-485s or no FP so far. I have a colleague who also filed one week after me and he got I-140 approved and no changes to I-485. I have no clue.

This is just a wild guess reading from the other postings for other service centers and approval trends. I am hoping that they are clearing i-140 in the first step. In the second step FP will follow and finally the I-485. God only knows how quickly that second step will start until we see some FP notices coming out.

I am tracking the worksheet and have a feeling that the FP notices should start coming sooner than later. :)

May be I am just day-dreaming.

I am not a expert or a lawyer or a legal analyst. So please do not assume anything.

My feeling is they plan to apply FOM memo to EB2 cases ( those that have 140 approval pending ) .. that's the reason they are not approving the EB2 140s .... I don't have the answer to the question as to why they would treat EB2 and EB3 in a different way ??
 
I140 Approval

Alright guys n' gals,
as I was hoping in my earlier post, my I140 was approved today :D

It's been a long road upto this point and it's a big relief. My first LC is still pending after 3+ years. My second LC was withdrawn after a 2 year wait. Finally, my company was generous enough to let me substitute for an unused LC from 1999. And things have moved pretty fast since then. I know I still have quite a way to go before it's all over, but believe me, it's a HUGE relief to get the I140 approved.

I now have one more thing left with my I140; my company was bought out after I applied my I140, so I need to figure out if I have to apply for an amendment.

Before I head out for partying, I would like to express my sincere thanks on a great job you guys do on this thread. For some of you folks to spend your time updating the tracker everytime there's an update - I mean it is just incredible! I just want to let you guys know that your time is very well appreciated by a lot of folks like me. Keep up the good work!

i applied concurrently 140/485/ead/ap both for me and my wife
i got ead/ap approved on sept 4th week but
my wife's not yet?
why like that
is there anyone with similar stage?

my nd for all 140/ead/ap/485 is sept 2nd 2004 .

Don't know which way this case is going to go now... Let me wait and I will update you all as soon as I hear something about this... The word Certified/Approved is what is giving me some hope...

On I40 Receipt, it said that Skilled Worker Sec 203 (b) (3) (A) (i) or (ii).
Don't know if its EB2 or EB3.
I'd guess it will be EB3 as I have shown 2 year exp on LCA
How do I know without asking attorney?

Do the blanks in I-140 Date field on excel sheet for the months of April, March and Feb really indicate pending status? or is is that people just forgot to get back to the forum to make an update?

Names from Feb, March, April in EB3 with no 140 date:
