2003 Consolidated Tracker ONLY (140/EAD/AP/FP/485)

I still think it still makes more sense to use this consolidated 2003 tracker for discussions. That way we can make use of the vast resource pool of more experienced users. It's not like things are getting approved in 3 months, so a lot of the issues that are discussed in separate 3 month threads are common to a lot of ppl in different threads. Some food for thought.

Because,

Labor applied to SESA office : May,2001
Labor approved at USDOL : Feb,2004 (just got delayed)
Applied I140 in March 2004 1st week
Applied I485 in March 2004 2nd week

I485 priority dates are much beyond May,2001.

HOPING YOU ARE RIGHT AND INS WILL ACT BY YOUR THEORY.
I WILL LET YOU KNOW IF YOUR THEORY IS INFACT A "FACT", IN NEXT FEW MONTHS.

You cannot get a I-485 approval if your priority date is not current. So an assumption is that this would trickle back to the I-140, why approve an I-140 with a priority date that can NOT apply for an I-485 better work on I-140 whose priorty dates are current.

Granted, priority dates for visa numbers are current but that is mainly because USCIS has not been able to process enough cases to use up the numbers.

But assume for a moment that priority dates were not current. Le's say its June 2004 and that immigrant visa numbers were only available for cases before July 2002.

Now assume you live in NH, where LCs get approved in 2 months. So someone with a priority date of Dec 2003. You would apply for I-140/I-485 in January 2004. Now it's June 2004 and you are waiting for approval

At the same time, some poor guy (like me) who is waiting in NY to get its LC certified has a priority date of Nov 2001. I getapproved in May 2004, apply for I-140/I-485 in June 2004.

In this scenario your application can not be approved by virtue of the backlog in visa number issuance so even if I submitted my I-14o/I-485 application after you, USCIS would work on my app not yours regardless of receipt date of I-140/I-485.

This is just a theory.

Hmm..Interesting theory! But not sure if BCIS follows any theory though, there's no logic in some applications being approved fast while others keep waiting forever. It all depends on the officer's mood and productivity levels on a day I guess.
 
On another note, the LC dates for Philadelphia is current. What did we do to have to wait over 2 years to get labor certified!! This makes me so mad!!!

All the illegals who filed during April 2001 slowed us down during labor and I guess are going to tie us up in 140/485 stage. The policymakers in this country are to be blamed, what they do to get cheap votes.

While we continue to struggle, paying taxes and all and doing everything to stay legal here, the illegals get their green card by being illegal, how unfair is that!!! Doesn't make sense to me. Make the good people suffer while reward the one who break the law!

What state did you file LC from and what is your priority date, can you add in spreadsheet?

Why dont somebody create another column for Fresh or substitute labor ? What does it mean LC State and LC Priority Date? Where do I find this info. Please let me know. I have used substitute labor

LC State - State were Labor Certification was submitted.
LC Priority Date - Date the Labor Certification was received at SESA/SWA, if you don't know you can use mail date (close enough)
 
Formatting excel

Can someone make the top headings non scrollable. Its very difficult to find which dates refer to what column. I think this will be helpful.

Just found out from my employer that my I-140 was approved in January. Also that I-140 was filed a few weeks before I-485, not concurrently as I thought. Updated with correct information.
