Could you please share your experience regarding RFE reply. Like what all documents were provided to prove the company's ability....

were the financial statements audited?

Was the company with loss in previous and current year?

Did our fingerprinting Friday (19 March 04) - called up the FBI status check hotline today (22 March 04) - they said they processed and sent back to USCIS the same day. No change in online status yet... hoping this will trigger something - like 140 approval - I know I know - this is wishful thinking :))
 
I140 EB2 filed concurrently in 2003. ND 07/01/2003. Approved on 03/19/2004.

EAD renewal filed online on 03/01/2004. Not approved yet.

No Finger Printing notice.

Who gets notified for the Fingerprinting? You or the lawyer? I have heard that they ask for the Fingerprinting when they close to processing your 485, so hopefully you will hear good news soon. :)
 
FP not related to i140 or I485

It appears that finger printing is handled by different group other than those handling I140 and I485. Only way an officer goes to look at the pending I140/I485 is when an EAD renewal is filed or applied for AP.

I have a colleague who has done 3 times finger printing (I485 ND Nov 2001) and yet no news about his I485 approval.

CIS sends notices to both - lawyer as well the applicant - both considered originals. In our case, we moved and CIS had our updated addresses too - still they sent it to old address and remailed it to correct address. In the meantime, our lawyer had sent us his copies. So we took those to FP. We still have remailed originals with us - it is immaterial which ones you take with you as long as it is an original.

We just mailed my wife's EAD renewal (1st EAD expires in August 04) - do I am counting on that trigering something :) Her AP is pending too - go knows when that will come through!
 
Hi, Any idea, How frequently does the service center processing times are updated? They are last updated on March 04 and now that there seems to be some progress with respect to EB2 approvals I am really eager to see the new date for it.

Finger printing

I have received my fingerprint notice. April 10 and April 13 for me and my wife. EB3 category. Notice date June 16, 2003. Still waiting on I-140 approval

Usually every 2 weeks. At least this has been the case for the last few months.

I updated my info.

I applied for my 2nd EAD on March 10, 2004. The first one expires on 6/19/04. I never applied for AP.

updated idocguru's details. JeremyR, you forgot to update the tracker, I couldn't find your record.

Some of the rows were out of place in wrong EB category, date range etc. fixed that too..

There seems to be duplicate records for ucnycus (eb2/eb3) and destiny, please verify and correct.

My wife recently went to India and her EAD/AP are valid until July, and her Finger prints now be taken LATEST by July.

However she won't be coming until Oct'2004. I have applied for 7th yr Ext, and would get approval by May'2004. Her H4 visa in the pass is already expired.

What are the consequences?(her not coming back in time)

As her AP will be expired by then, Does her I-485 be cancelled autmatically?
You need to have AP to travel outside US during AOS. Only people having valid H-1/4 or L1 status are exempted from this requirement. As you said she is not on H4 currently and her AP is also expiring, I would suggest her to come back or get H4 stamp on passport before AP expires. She is putting her I-485 in danger if she decides to stay outside US without AP or valid H4

As her Fingerprints last date be over by then Her I-485 be cancelled ?(it says, if FP not done in time, the application will be abandoned) what application are they referring to?
Ask your attorney to reschedule the FP by sending FP notice along with a letter.

Can she enter US (whether I-485 expires or not) with Valid H4?
Yes

If her I485 is expired, can she apply I-485 again?(after coming with H4.
Check with attorney.

If had to change the job with AC21 portability after I140 approval by Oct'04, can I/she apply her I-485?
Is it connected to previous question?.
