My I-140 got approved today 04/14/04.

Here are the details

Concurrent Filing, EB3, No RFE

MD 05/28/03
ND 06/09/03
AD 04/14/04

EAD was approved last year on 06/29/03

Please update the excelsheet as I do not have the excel on my PC

AP approved...but still I140 pending

2nd AP got approved today. (ND Jan7, 2004). However my son's AP is still pending

I wonder if it is the web update mistake, because I see the similar type of message for my EAD case status.


However still I140 is pending. A decision on 140 should be on the way (RFE or approval).

for ability to pay 'NET CURRENT ASSET' should be higher than the proferred salary. How can it be rectified for the past? It can't because tax returns are already filed. so in that scenario I140 is doomed!! It is too bad...wrong place, wrong sponsor and wrong timing. I.e being in a wrong place at wrong time. During boom time (1998-2001) similar situation wouldn't have occured.

I think you did the right thing of approaching Senator to initiate inquiry on your 140 .

Did you get any letter from them or Did they write directly to INS ?


Please give more details - and any body whose ND is past of INS's published dates - may follow the same approach .

Both Senator's and Congressman's office called VSC and spoke to the supervisor of the I-140 section. Both the offices received a letter from VSC indicating a 2 weeks period for decision on my case. Accordingly it is approved in less than 2 weeks from congressional inquiry.

AP approved

My AP had been approved.

RD for 140/485/765 - mid 10/03

Where does the AP go? To lawyer or my address.

I am eagerly waiting for EAD also.
Where does the EAD go? To lawyer or my address.

AP notice goes to your lawyer (if you have one representing, if not comes to you) and EAD comes to you direct.

AP to attorney!

For my 2nd AP/EAD I applied myself. Does this mean the approvals will be mailed to the attorney? In AP/EAD application there is an address field where the person applying for it fills in. I am expecting to arrive at my doors.

If they go by G28 then it gets to attorney. I hope I don't have to contact my attorney for this.

Usually people receive 3 AP notices. Some have also received 2. Your lawyer may take a copy for his filing purpose and give the rest to you. Our lawyer gave all 3 to me. My husband applied later, for him he took one and gave only 2 to us. So it depends.

In your case as you applied it by yourself (there will be no G-28 for these 2 applications as you did it, am I right), you should receive them direct. Anyhow this is not first hand info, I have read about it in this forum.
