Do you apply for renew? if so, you need to mail a copy of your original EAD approval notic and the EAD card you have (front/back). If you apply first time, you need to mail the original I-140 approval (keep copy for your file). Good luck! (don't forget to pay the fee $340).

I'm not sure about TX, but in CA, if your daughter included in your AOS then she is considerd "In-State" student. (She was under 21 when you apply for I-140 & I-485).

Hi Bostonma786, I suggest working in your H1 extension first before upgrade I-140 to PP. Normal processing time for I-140 is about 6 months, so you will get your H1 first. This way you get away from risk of REF or deny your I-140. "Just my opinion, this is not a legal advice." Good luck.

No. To apply for 3 yr ext, you need approved I-140, your PD not current when apply for H1 and when approved also. If your PD become current befor H1 approved, no 3 yr, only 1 year extension. If this is not correct, please correct me..
