I think there will be a Q with the supervisor and there will be no specific timeframe for approving these cases. This is what I understood from the messages posted on these forums after talking to IOs. And about "sue-ing", I don't think you want to go that far :)
Based on my understanding, petitons that need extended/additional review would go to supervisor. Why a petition needs extended review ? I am not sure how they decide on that. Good luck and hope you will hear something soon.:)
do not worry. In some situations, it takes months for them to approve after receiving RFE response. My I-140 was approved 3 months after my RFE response.
Actually it depends on both. First the PD should become current in order to become i-485 eligible for adjudication and then RD sequence follows as akkgc said.

I think there is a latest update in AC21 rules. I just read it on the homepage of www.immigration.com. Per new rules, one can switch jobs before I-140 approval but after 180 days of I-485 application. So you are eligible. Take a look at it and talk to your attorney. Good luck.
My first guess would be they are trying to adjudicate your i-140 and i-485 together in case you filed them together. Because Ability to pay is intended to employer and generally issued on I-140.
