Here is the sequence of events.

8/18/2005 - I call USCIS for changing address and also request to do a status check on my case. Here is what I got on 8/19.

The address has been updated in our records for xxxxxx and xxxxxx Your application/petition remains awaiting review by an Officer and you will be notified as soon as a decision is made.

8/20/2005 - I call USCIS for status inquiry. Here is the response recd on 8/25.

The processing of your case has been delayed. We are currently awaiting the results of required security checks on this case. These background checks are required of all who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the security checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided below.

I asked my area congressman to do a status check on my case on 8/25. here is the response..

There has been some progress. A supervisor has ordered your file and
will review it in the next couple days. She believes a visa is available to
you and it appears the security check has cleared. However; it appears your
fingerprints have expired so new ones will have to be taken before your
case can be adjudicated. I should hear back from her no later than Monday.
I'll be in touch.

I do not have any latest update from congressman's office as they seem to be busy with Katrina related isues.

I DO not know at this point if..

my case is pending for security check..or some other reason.

I've not recd code 2 FP notice and now since my FP that was done on 5/20/2004 have already expired I need to do code 3..

Anildel...have a quick question..which phone# & what options..?

Which USCIS phone# you called to reach officer...basically curious in which options you selected...

Thanks Mr. Green for your response and Malia for pointing out the LINS..I didn't notice while copying. WOULD YOU PLS REMOVE THEM FROM YOUR RESPONSE.

My purpose of putting all this here was to share the info as well as to bring out the difference between three status check respponses.

One response indicates that it is waiting review by an officer while other says it's pending due to security checks and last one shows everything is in order but finger prints have expired. I don't rule out the possibility for a fourth type of response if I request senators to do status inquiry.

So to all the people who're getting the security check response should not trust it first hand.

Malia..I did just 800 number and CS rep submitted the status check request.

Hi, anildel,

It seems to me that the second response you got is a generic one from USCIS. The first and the third one make more sense to me. You should receive your third FP soon.

Similar to mine (see my signature).

Seems many Nov 03 cases are screwed by USCIS. A month ago I scanned cases of the same RD and few was approved.

I think you are correct. Nov' 03 cases are damn slow. There are not many people that were approved from Nov' 2003. :(
 
latest update

the latest update recd from congressman office confirming that

1. my case has been cleared of all security checks. (refere to USCIS response above saying it is pending for security checks).

2. the case is lined up for Finger Printing. I should receive notice in two weeks at most. If I need, They can assist me in checking the progress further.

It conclusively proves the point that USCIS response was fake. They don't even look at the case while answering status inquiry. They seem to have some standard response templates randomly selected in response to inquiries.

If anyone gets a response that the case is pending for security checks, pls try to verify it whatever other ways one can have access to.
 
I got the same message in email "delay due to security check", do you guys think I should contact the local congressman to verify this? Would USCIS response next that the case can not be approved because the PD is not current?
 
Please also post your online status message... mine was changed from 'pending review' to "processing has resumed on your case..." last June when my 140 was approved.
 
You may try through Congressman Office. Request them to specifically ask if the case is cleared of all security checks.

I'm afraid that come Oct 01, all responses for status check are going to be "visa number is not available" in response to status inquiry whether asked by congressman, senator or the applicant..unless an otherwise concern is addressed specifically.

The Ans for my inquiry was " All of the visas for this type of application have been used for this fiscal year. More visas will be issued again on 10.01.05". Does this mean that my application is waiting for the visa nos and will be approved as soon as they are available??? please suggest....
