Help needed ...Employment RFE

I have received RFE for employment. I am with same employer since the GC process has started (PD May 2002, RD, Jan 2003). The problem is my salary is appx 10,000 more then what I was getting that time. Also it is 5,000 more then what currently is appropriate for my job.

My lawyer says it could be a problem.I don't understand what to do. Can somebody guide if they had similar experience ?
 
potentially the extra renumeration indicates job duty changes contrary to the original labor cert and I-140. They could ask you to do it over again.
 
It depends on the Labor Cert

If you are above the $ amount mentioned in Labor cert and you are in the similar job position, there won't be any problem.

I am not in your boad but in my understanding you should be just fine. I guess your lawyer should be able to justify it based on 3 years duration and your excellent performance thereby increase in your salary.

I wouldn't worry about it but would surely get few more legal advises from some good layweres.
 
I do not think 10 K more should be an issue. I know my friends who got more than 20K difference and got it thru without any issue.

As long as job is same / similar, you should be fine. The salary on LC is minimum to be paid to prove ability to pay. More than that should be ok. A lot more difference could alarm for different job.

I was in similar situation . you should be able to justify the raise in salary.

You said you were in similar situation...did you get an RFE for the increased pay? how did you handle that? please share the info.
 
As far as I know, one should need to worry only if the salary is less than the one that is specified on LC. I am surprised at your lawyer's reply. Thanks!
