In your neighbor's case, How much gap was there between the visits? I'm thinking along the lines that a long gap (say 2 to 3 years) between the visits that wouldn't have triggered the visa denial at POE...

UPDATE: The application was denied.
1) The reason they mentioned for denying was the reason for extension provided (traveling in US) doesn't come under the B visa nature blah blah.
2) it says they didn't initiate the "removal procedure" yet. But if the person don't leave U.S within 30days...

My mom was given multiple 10 year visa, during her last visit we had to extend her visa twice and it was approved both times :) She then left before i-94 expires, stayed out of country for 2 years, and wants to visit us again now.

I just want to update on our case. My wife entered u.s without any problem. we showed AP, i-485 approval to the officer at POE. We were then asked to goto secondary inspection and there we got i-94 card. no questions asked.

update - The company attorney called me, they are still looking into this this, they will bill me $250 per hour for consultation. i hope it's only a few hours otherwise it'll be too much for attorney fees.

thanks for your respnses. It may be a mistake to travel on AP (after knowing that the i-485 is approved, It was partly due to not getting the appointment via iPass system).

I've contacted an attorney and provided all the information about the case. even the attorney hasn't heard such a weird scenario as one travelling without stamping after knowing that the greencard is approved. I'll update you all what they says.
