I probably will go the route of a 2nd I-140/I-485 concurrent filling based on approved LC.
In case the 2nd I-140 get rejected (with my luck anything is possible), my previuos NIW/ EAD/AP will continue. Let us see what happens.

I used AP to re-enter the US. I also have valid H-1 status. I would like to continue my h-1 status along with the AOS, however my lawyer is saying that I cannot file for extension of H-1 because I used AP to re-enter.

I did apply for 7th year extension prior to the completion of 6 years even though my I-94/I-797 is valid for 2 years more(INS mistake). My application is still pending approval
