Good luck with your AP getting approved.
Fact: You are not supposed to leave the country when AP is pending. If you do, USCIS cancels your application.
Fact: Lots of people have received AP approval after they left the country on a pending application. And have returned using the AP...
@s2010, as jk0274 mentioned above, you'll have no problem renewing your AP or your EAD. Just keep in mind that you'll need a valid EAD if you are working or before you can start work.
Seems to me that you haven't filed any applications with the USCIS recently? There is no receipt number on the back of your check now.
@kulkarni_ash, I know for a fact that the Nebraska center has some processing delays. My checks were cleared after about 2 weeks and it took another week or 2...
I'm trying to schedule an appointment and wanted to check the available dates. But I don't get the calendar of available dates for the visa appointment on the vfs-usa website.
Basically go to https://www.vfs-usa.co.in/ApplnForms/EarliestDate.aspx.
Fill in the info to find the earliest available...
Unfortunately, NO.
Unfortunately, YES. So make sure you have all the paperwork ready before you get back here. Once you get back, apply on the same day as you land, or a day later. Make sure you apply electronically so you get a receipt number immediately. Send the necessary paperwork and then...
H1 job doesn't come into play here.
The job profile and the title should be identical or as close as possible to the one filed for your Green Card. Also take a look at the AC21 subforum to get more answers about changing jobs and invoking AC21.
If your 485 gets rejected, yes, you have to go...
If you are worried about Transit Visas and stuff, take one of the direct flights. Since I usually fly to Delhi, the only one I know of is Newark, NJ to Delhi. Its non-stop so when you board, you are in US, when you land, you are in India.
I live on the west coast and have booked SFO -> EWR ->...
If you are working on EAD then your H4 is not valid. You read it right, if you used your EAD, you left your H4 status. To travel outside the country now, you'll need an AP. Apply for an AP as soon as you can... when you get the USCIS Receipt Number, call USCIS and tell them you have an emergency...
USCIS has changed the way it processes checks. Its an electronic transfer and hence the receipt number is no longer written on the back. If its cashed, your receipt date will be the date it was cashed +/- 1 day. And you should be expecting the receipt in the mail soon, unless your lawyer filed...
Form I-131instr (instructions) gives you all addresses under the "Where to file" section (pages 6-8). It also has a phone number (end of that section) that you can call if you are uncertain.
You need an Advance Parole document to travel outside the country if your 485 is pending and you don't have visa. EAD is just a work permit and has nothing to do with exiting or entering the country.
To apply for advance parole, you have to fill the form I-131. It takes up to 3 months for...
From your post it seems like you had applied for your 485 then got married (on H1) and applied for your wife's 485 when the priority date got current but your 485 got approved and her's hasn't gotten approved yet.
Anyway, to answer your questions,
Yes, she can re-enter using her AP as long...
I've heard this for the first time. Specially the fact that an immigration officer told you so. But I would advise you not to travel on that AP. You are not going to meet the same officer again, are you?
The fact is that you cannot use an expired AP. The "Paroled Until" is just like an I-94...
Thanks for the detailed reply.
What you mentioned above makes sense but raises more questions in my mind about someone entering as a parolee, without status, and having an existing H1B. But I'm past that stage as I am using my EAD to work instead of the visa so that question is for someone else...
Hi Everyone,
I was paroled into the US on Apr 11, 2009 and my AP document has a stamp that says:
Paroled
Until: Apr 10, 2010
Purpose: AOS Applicant
Q: Now my question is what happens after that date? This was the first time I used my AP.
My concern is that I don't want to be out of...
