thans ChrisV! does it matter within 30 days or after 30 days? What would be the best way to explain the new petition? the previous submission was in a rush and didn't include enough evidence? Or something else?
Thanks to all for the support and advice!
One more question here: If I resubmit a new peition, do I have to tell them the decisions (RFE and denial letter) with my existing petition? Or because it's not final yet (within 30 days), I don't need to tell them? In another way, does it matter...
Here are my credentials: I am a tenure-track assistant professor now and I chose the category "university/college teacher" in my 140 (I am not sure it's the correct choice because the USCIS basically would not consider my achievements during my PhD study or anything before employment due to this...
Dear all,
my EB1-EA case (self) to TSC was unfortunately turned down after my response to RFE. I am wondering if I should do an appeal. If so, how to do it? Is it similar to doing an RFE in a way that I need to write a detail letter in response to the points in the denial letter? Or, can...
Triv,
It seems that we are on the same boat. It's difficult to work on the RFE because somehow I kind of lost my momentum. But Let's fight back together. I just contacted people to get some additional letters because this will take some time. Next I will work on the letter again...
triv - so sorry to hear this. Call them again to find out if your documents get lost. Or get a fax copy first so that you know whether you actually received your documents or not. Never lose hope, I believe we will succeed eventually.
map-map - yes, you can e-file 907 (PP) after you e-file 140. However, there may be a problem - supporting documents may get lost when they transfer from regular service to PP service.
milli - sorry to hear that. If you want to get a fax copy, you can call them. Anyway, don't lose heart. I also felt a bit frustrated these days because of the RFE. But I know I need to fight back. So I give myself a few days not thinking of this. Hopefully sometime next week I will start...
Thanks madgu and dgrajan! This is really big help!
One critical question after I read the RFE letter more carefully. The main question seems to be that I provided many evidence predating my faculty employment (e.g., awards/publications during PhD study and earlier). So they ask me to...
brewtus - any update? I received my faxed RFE today. And in the letter, it says "Include a copy of this letter and place the attached red/fax sheet on top of your documents". So I guess I also have a red sheet. Anyone has a clue what this indicates? Good or not good sign?
Also, on the...
Thanks madgu-gc2005!
Also, if I mail them the response with new and old supporting documents, should I prepare it in a way similar to the original submission (i.e., new cover letter plus all supporting documents--new and old)? Or should I keep the new documents seperate, while also including...
I just got the RFE in fax. They actually sent it to my office yesterday (before I called them to ask for a fax copy). They did process it and the RFE asked some specific information. They did ask the question regarding degree and employment (I got PhD in 2006, but started faculty employment...
Triv - because I have some evidence in foreign language, so it has to be translated into english. The statement is just to certify that the translation is accurate. Check it out here...
Triv - thanks! If it is 90 days, that would be great! I didn't do EB1B-OR because I think I can do myself much faster in 1 month (the university and its lawers will need about 5-6 months to do this).
Triv,
thanks! I got my Ph.D. in 2006 but started as an Assistant Professor in 2005. This is common for my area. If the PhD is an issue, that would be bad.
CRIS sent me email at 8pm. It's the standard message online. Here it goes:
pplication Type: I140 , IMMIGRANT PETITION FOR ALIEN...
