But in JAN 2005 priority date of Nov 2000 for EB3 was current. Not sure how they told visa number not available. As far I know approval 140 does not depend on 485 approval and in your case PD NOV 2000 was current in Jan 2005 and a visa number is available if PD remain current during 485...

AP and H1B are ment for different purpose. So one can work on H1B after using AP.

As far I know if the job requirement (Qualification and Experience) for which LC is approved needs EB2 then one can switch from EB3 to EB2. Even though you qualify for EB2 now , you may not change to EB2 if original job requirement (Qualification and Experience) was for EB3.

My guess. I think though they work on a case whose PD is not current, but only approve a case when PD become current. No one knows the exact procedure. :)

You need to show all three copies at POE. Officer will stamp on that square, which says "stamp here" in all three copies and return you two copies.

Priority Date(PD) is the date when Labor is filed to State. Notification Date(ND) is the date when CIS allots a case number and starts processing.

ACDC, I have also a RFE on 140 but letter mailed by uscis on Mar 28th. Do not know when attorney will get that and what they are asking. BTW after how many days your attorney/company received RFE ? You may take help of UnitedNations if your company does not help you. good luck.

Thanks ACDC . I got a mail today about 140 RFE. For 140 after LUD on Mar 18, 21 and 22 finaly I got the mail below. "On March 28, 2005, we mailed a notice requesting additional evidence or information in this case." :confused: No change in 485 LUD, received EAD card today.
