whats ur PD? and are u from India, China, etc. who are affected by EB3 retrogression? if you are then maybe the RFE is that you cannot apply for your 485 just yet...have to wait till your PD becomes current. However, they should accept ur 140 application.

thanks for ur response. as per my J-1 visa requirement at the time (89-90), the only requirement was that i return to my home country. there was no requirement of 'time limit' like for at least 2 yrs or something...at least not that i know of.

140 RFE was for EVL and W-2 for 2003. the lawyer essentially re-submitted the same EVL originally provided at the time of application and also did a 'calculation' based on EVL to reflect the total work exp.

I need a clarification. Our CP lawyer says that I absolutely need a J-1 waiver. I also have another application in 485 and that lawyer says I do not need the J-1 waiver. Who do I beleive? At the current rate, our CP interview is going to be in March 2005.

1. you are correct...TIN and SSN are two separate things. TIN is issued by IRS and SSN is issued by SSA. I would check 'No'.
2. Based on what I have read on this forum, different folks have put down either the primary applicant's employer information or the primary applicant's name...
