My understanding of the priority date is the priority date for derivative applicant is derived from Main Applicant. So in this case if ABC is main applicant with priority date of October2002, if Priority date retrogresses to June 2002, XYZs application will also not be touched. So XYZ too has to...
Please read the message carefully.."On October 22, 2004, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283."
USCIS is responding to the request which made...
Thanks for your help in trying to clear the ambuguity of the priority Date for Labor Substitution cases. The reason for the ambuguity is interepretation of Priority date differently by different websites..
1) Immigration.com site says for substittion cases, it is 140 date.
2)Murthy.com...
It seems his 485 application will be adjudicated by local district office in Norfolk by scheduling an interiview. They will call him for an interview as per their processing dates. The processing dates of the concerned district office are available at USCIS website.
I am runnina a scanner on 485...
FP Notices
I dont see many FP Notice posting lately on this thread. Most of the postings relates to 140 approvals.Have they stopped sending FP Notices.?
I think in Labor substitution cases also location matters.Since the substitued alien has to file another 750 along with 140 filing to the USCIS.In this 750 the location has to be same as the location in Original 750.Otherwise,original labor cant be used.
LUDs
I dont think there is any pattern for the LUD changes.My140 LUD changed first time when my 485 is filed. The next time it changed only when it is approved(10/12).But it changed again on 10/13(I think this is when mail room guys did some action..)
They will accept both the applications. But USCIS will not adjudicate 485 till it reaches the priority date. But I guess, you can get EAD as well as as use AC21 if 140 is approved and 6 months passes.

But both gave complete different answers.Jaisharma, it seems yours is a labor substitution case and 140 got approved recently.Does USCIS mentions Priority date in 140 approval notice..?If so what date was there on your approval..?
Thanks
Guys,
Can some one shed light on this as it is being speculated that USCIS/Department of State may impose Retrogression of 485s atleast in EB3 cased as early as Jan 2005..What will be the priority date for Labor Substitution cases..Is this 140 filing date or Original Labor filing date with...
Congratulations on your quick 485 approval..I have question..You said yours is a labor substituted case in EB3 and your priority date is 2001..Does it mean that priority date is of the labor filing date of the original labor certification..?
Because, I am confused with some of the sites saying...
FOM action in TSC
Guys,
As per "http://www.murthy.com/news/n_tsc140.html", FOM seems to be in action atleast now in Texas Service Center(TSC).The current TSC policy is to process concurrently-filed I-140/I-485 cases according to the I-140 processing dates which is July 2003. Interestingly...
