Effect of the EB3 Dates Retrogressing

Hi,

With our great luck and the apathy of the Immigration dept, the dates for EB3 will be going back sometime in late dec or early jan. With this in mind, I have a couple of questions.


1. How far will the dates retrogress...2002 or 2001..

2. How fast do these dates move from month to month?
i.e, Say the current Priority date as of today (1st Nov 2004) is June 2001,
come Dec 1st 2004, will the Priority Date move to July 2001

Has anyone looked at some historical data, and If so where can I find it....

3. Will there be parity atleast now in the adjudication of these cases? FIFO???
Can the dept guarantee that the files of the guys who have filed first will atleast be LOOKED at before looking at other files which have been filed later...

Any answers will be greatly appreciated.....

If you don't follow recent news then keep quite. Do not dismiss them as crap. The Eb3 cutoff dates are expected to regress to some time in 2002. The Eb3 people cannot apply for I-485 until your priority date is before the cutoff. If you already applied for I-485 then your case will not adjudicated until your priority is before the cutoff date. This news is from very credible source: http://www.shusterman.com

I believe that this will only affect people from certain countries (within the employment based catagory) but I don't know the exact details. Nobody knows how far the dates will regress at this point, although the speculation that I've seen suggests that it won't be "too far"...

eb3 dates retrogression

this should only impact who files 485 newly. As for people who already filed 485 under Eb3, will there will be an impact on the adjudication?

Yes, if you are from one of the aforementioned countries and the EB3 cutoff dates regress to before your priority date, my understanding is that your case will wait until your date becomes current again. I'm not sure how many people this affects because many people who went through LC started this a long time ago (i.e. 2+ years) at this point so their priority date might be in 2001 or before the new cutoff dates.

People from one of those countries who haven't filed their (EB3) I-485 yet won't be able to file until their priority date is passed which means no adjustment of status status and no EAD etc. in the meantime (since these need a pending I-485).

At least, this is my understanding of things -- please correct me if I'm wrong...

Can someone please answer the questions above. I seem to be getting the answers only for question 1 ....Anyone who has experience or information on the historical BCIS trend.....

A priority date means the day you have filed your labor certification and not the day u filed ur I-485
 
What will be the Priority date in case of substitution?

What will be the Priority date for Labor substitution?
Is it labor receipt date or the 485 receipt date?

In a labor substitution case, the priority date will be the date on which the labor was filed and NOT the I-485 date

I don't think anyone can answer those questions based on the info that we have currently...

For #2: the priority dates have been current (i.e. today's date) for a long time -- once they stop becoming current it's not clear how quickly new PR numbers will become available.

For #3: we aren't seeing FIFO currently so I don't see why they'd become FIFO in the future...

'priority date' on my Finger Print notice is showing as the receipt date of my I-485 aplicaton.

But 'priority date' on my i-140 and i-485 are showingBlank. So I was confused.

---Your priority date will be attached to your petition only when 140 is approved.It seems, your 140 is not yet approved, the date column in 140 and 485 is showing blank.Once the 140 is approved, your labor fining date will be attached to your case as the priority date

Is there any chance of EB2 retrogressing?

How do we know whether our app is EB2 or EB3??

Check your 140 receipt.If the application type is Skilled worker or Professional it is EB3.If it is Advanced Degree, it is EB2.

Mine was a labor substitution (labor priority date 11 may 1998).
I-140 ND: 4 Dec 2002, Approved: 22 Jan 2004
My I-140 approval notice has the priority date filed filled with 11 may 1998.
