    I'd say your odds of rejection are higher than 50%, but it is possible to overcome the presumption that you broke continuous residence. It's probably worth a try. Three years? That GC is abandoned. She'll need to be petitioned again.

    If an I-130 needs filed, there's no need to wait. One should lock in the priority date as soon as possible, and since he's got an L1 there should be no issues on entrance.

    You have a Social Security card that say valid for work with USCIS Authorization, right? They'll want to see an EAD. An F-1 as I understand it is not work authorization on its own.

    No, the I-129 and LCA do this. The letter has no legal significance.

    Strictly speaking, all that is required is the I-129 for an H-1, and for a TN merely an offer letter to the alien applicant with the necessary info is necessary. As a matter of practice, attorneys tend to create cover letters for their petitions - I wonder if anyone at USCIS ever reads them.
