this really pisses me off...robbing law-abiding tax-paying immigrants and making them wait years to generate more revenue and then having the nerve to increase the fees by 300% without real service improvement... no wonder illegals have all the fun!

According to the new GRAND BARGAIN rumor, the new law will not increase EB quota and instead replace EB Green Card system with Merit/point based one.
Big question is what happens to existing pending cases? Do we get shunted to the new system with new PDs or carry over the PDs or the EB cases...
Let me pitch in with my opinion:
There is no way in hell that they can use the transfer date as Receipt date...no moron in the world can come up with such a stupid concept. That is wrong on so many levels that its inconceivable.
First, its unfair to all EB-VSC cases as compared to TSC...

I think the service centers never had a clear idea how many cases they had, how many they were receiving, how many and how fast were they processing these cases. They just didn't have a finger on the pulse.

How does a "person on substitution labor with PD later than original labors could get approvals"? All cases with PD which falls within the date specified in the bulletin has a chance of approval, original or substituted.

Not to sound discouraging but if one of the reasons specified for denial is offer letter and the MTR still doesn't contain it, its not going to help. Especially since its a such a central and critical piece of the application.

How were you able to maintain such a nice 12 month gap between your EAD approvals? Were you not losing months every year because of that crappy "file 90+ days before expiration" rule of thumb?
Can you please provide the reason for the denial and your response (MTR)? If you are from India, the PD should move up again in FY 2007 which is Oct 2006 so even if they do not process your case now, as its past the cut off date, that shouldn't matter too much. Although I think in your case...

Its my understanding that if you have a valid H1B at the time entering on AP:
1) There is no need to apply for EAD and can continue working with the valid H1B
2) You can just do an H1 transfer later on.
I will suggest you consult with a lawyer regarding this as its such an important issue...
