If we are taking about dependent (not primary) claiming benefits on EAD (not H1), I don't see a problem. My spouse who is also on EAD has claimed unemployment. Her 485 application is dependent on mine. I know more than one person who did the same and eventually received their GC without issues...

I think they are spring-cleaning. With hardly new GC cases to work on due to retrogression or much H1b demand, they don't have much work to do so they are dusting off old cases to see which ones can be easily denied and which ones can be conditionally approved (until visa numbers are available)...
Thanks for info and words of encouragement. But my PD makes my case impossible to be adjudicated positively (as in issue of a visa number for my green card) in the next few years. But if they want to deny, sure, there is no retrogression for that ;)
Anyway, I am not too stressed about it...
So I finally get an 485 RFE for both my case (primary) and my spouse. Just an email, nothing in the mail. This will be my first RFE in the tens of applications I sent to USCIS over the last 8 yrs. And that too when my case has no chance of approval for years to come. Anywa, will keep you posted...
Same here. Was always able to add the case to my portfolio but this time its giving me the "can't find case" error for both adding and just doing a case search. Hopefully its a temporary glitch in their system.
I met my lawyer and surprisingly he has asked me to continue working if the employer hasn't asked me to stop. He said he has never seen a case rejected for "small" EAD gaps (if the combined gap is under 180 days). So there you have it.. I am going to try my luck and continue working without EAD...

If she has used her EAD, then I would guess her current status for that field would be "A.O.S. (adjustment of status)". But don't take my word for it....especially if you are working on a valid H1 and her H4 has also not expired (in terms of validity date). This may be one of those corner...
