Finally, after 16 months of dealing with immigration, my wife is in the USA, but it was a close call . . .
We got the letter telling us that the interview would be 8:00am Friday December 1, 2006 in Rio. We got there a day early, because brazil was just starting to have problems with cancelled...
If you cross the California/Arizona border near Yuma, there is a 95 percent chance that you will get stopped at an immigration check point, that is manned by INS. They will deport you, if you do not have your papers.
Amen to that. They rejected my I-864 because I did not put N/A in any blank answers, even if they do not pertain to you.
When I resubmitted it, I had "N/A" all over the place, even if it seemed rediculous, and my application was accepted.
If this is the first approval. it means nothing, except you filled out the paperwork correctly. You need to check the USCIS website and look for the Califormia office. It will tell you the dates of the I-130's that they are currently processing. When they process your file, then you get to start...
I have heard from others, that if you have a foreign drivers license from certain countries, all you have to do is pass the written test. Every state is different, but this is pretty common practice. Some people have even used their foreign license here.
Depends on the state. Just go down to...
Can they get married in Mexico, and then file directly through a US Consulate in Mexico?
Fortunately for you, if she is here illegally, it is easy to get back to Mexico. I have seen too many horror stories of people getting caught entering illegally and getting that 10 year ban. Be very careful.
As long as you do not live in the Southwest. Otherwise a year is not uncommon. The fiance visa is much faster than the marriage visa (for some unknown reason.)
From what I have read, you might be fine. Unfortunately I am no expert.
One thing that I have noticed is that there seems to be a higher than typical rate of divorce in this forum. I wonder if that is due to the stress of going through this grueling process?
I do not know the details, but I ma pretty sure that nowadays most governmnet agencies know that an arrest is meaningless. What they are usually concerned about is whether you are convicted.
Many people get arrested and not convicted. I know that on a job application, in most states, they are...
The NVC is still very confusing. All they did was send me the blank forms for the new I-864. They told me that they were going to tell me what corrections I needed to make, but they did not.
I had already sent the new I-864, before they sent this in the mail, so I do not know if I need...
Ends up they claimed to have sent me back my I-864 about a month ago, but I never got it.
They said I forgot to put "N/A" is several places and did not sign the first section. They are sending back the original. They told me I need to fill it out again.
I think I am going to beat them to...
I submitted the I-864 in May 2006. I just got a letter from NVC telling me that they got my visa application, but they are "still waiting for a response to the checklist letter for the Affidavit of Support." They say that before they can continue processing, and I must send the missing financial...
I always Fedex. They are a little more expensive, but have later hours. The Post office and UPS are cheaper, but you need to get it to them earlier in the day.
Here is the deal as I have experienced it.
The best situation is for her to come here first on a visa from India, and then marry her here. If India does not allow that, then you can marry her there, stay with her for a while, or wait for her in the US.
If the India consulate makes you file...

The first list are the documents which can verify employment eligibility without any further evidence. Otherwise you have to show two original documents from the other two categories. Basically a valid ID, and proof that you can work here.
No...
I doubt it.
The rules are pretty strict. Basically if you have a passport, that will suffice. Otherwise (Going by memory here) you need two forms of ID, one picture, plus proof that you are allowed to work in the US, if you were not born here.
Sounds like you are going through the same process I am. All you can do is wait until the I-130 is approved. It took us about 7 months. You can check the website and see what RD they are processing. Then you do the math and see how much longer it will take to get to your application.
Then you...
They also updated the forms after this guideline was created. The new forms follow these guidelines. Some of us were caught between the guideline update and the form update. Be interesting to see what happens if we followed the new guidelines, but used the old forms.
I called the NVC and am very dissapointed. They received all of my documents on July 7, and the recording claims it takes 6 to 8 weeks for approval. After approval, then they send everything to Rio, Brazil, and hopefully an interview letter gets sent.
It looks like my wife will not be able to...
