Check your I-140 status Can you check your I-140 status filed by your old employer. If it was not cancelled, I think you will be in good position to use AC-21 rule. Some companies to give trouble to an ex-employee, withdraw I-140. Please post the info.

LIN no is based on ND INS issues the LIN numbers based on the ND, not on RD, So if your ND is October or after that then your LIN comes under next year, so is- 02

Aproval based on RD You both will get your aprovals based on your respective RD/NDs, As per as my knoweldge you both won't get it at same time

That's standard message I think that is standard message for RFE cases. Don't worry your case will be approved within 3 weeks after AVM update date. I know many I-485 RFE cases whose RFE message was like processing takes 420 days and got approved within 3 weeks.

AP not required If you are not used your EAD. AP is for those who uses EAD to do job. I know many of my friends who has EAD, but never used them and went to India without AP.

Priority Date For Indians PD bacame current for EB3 on july 2001 and for EB2 some time in Feb 2001 ( I am not sure)
