As long as you can prove how important your work field/ contributions are, as far as I know, you dont have to have a PhD degree.

I dont think you can use AP when you are with EAD. That will definitely cancel your H1B status.

Snafu After you are done with your first lot of H1, I thought you had to stay out of the country for 2yrs. Is the time period one year? Thanks for the info!----I like your plan, incidentally.

As I understand, once you have an approved I 140, chances of 485 approval are extremely high. So it is much safer to switch to your EAD at that stage, rather than with a pending 140. However, consult the Gurus for the final word on the subject :)

That way, even if I-140 gets regretted, you are with a legal status.
