You are correct, During 2002-2003 when the job market was bad many employers applied in eb3 .My case comes under this catagory too,when i asked my lawyer he told the same what you have stated above.

My info Guys, Like you i also effected by regression and i and my wife applied 485 at that time my daughter is in india .I applied after she comes back and INS returned her application saying that no visa numbers available and pd not current.now i am waiting for PD long way to reach 2003apr

I gave same finger prints Guys, I got the type 1 finger print notice and gave them (they took only thumb print) aug 2005.No responce and no online update .I think because of visa number regression they are not opening the files.
