That is not true. Medical should be done with 12 months preceeding the *filing* of I-485 and not the *adjudication*.
As you can seefor the RD:9/99 cases being approved now, INS hasn\'t ever request a medical redo, even after 15 months.

Do it now. You dont\' want to delay I-485 any more than necessary! One RFE cycle from/to INS typically delays the process by 2 months.

Mu gut feeling is that INS will come up with the new regulation by April and may decid that I-140 re-do etc. is not required for mergers/acquisitions especially in view of the new 180-day...

Interesting observation! This might especially be true since a while back VSC had stopped working on I-140 (as per AILA) and focused their attention on H-1Bs.
With the economic slow down, I expect that H-1B workload would have reduced considerable and VSC might be clearing I-140...

Here is a solution: Opt for consular processing in I-140. If you have already filed I-140, wait for approval and then have it directed to NVC instead of ifling I-485 (which you cannot do anyway as you will be out of the country.
I would recommend consulting a good attorney first.

Employer cannot "start using it" unless you formally present it to him as a proof of employment authorization. Possession of EAD should not affect your H-1 status.
