Is Premimum Processing recommended?
Once again thanks Ginnu for your feedback.
I am consulting a lawyer who is also going to file the H1B transfer petition. Lets wee waht they say.
Is it a good idea to do Premimum Processing for transfer in this case so I can find out sooner than later...
What would the outcome be?
Thanks Ginnu for the feedback. What do you think the consequences will be? Will USCIS reject the H1B transfer? Will they approve it without I-94? If they reject it can it be appealed?
What is the most likely think that USCIS will do?
Any advise what should I do...
Hello,
I just joined a new company and started working. I am also getting paid as promised in the offer letter. But the company has not filed the H1B transfer petition yet with USCIS.
I was told that the petition would be filed the same day I joined the company but it has not. I am told...
Hello all,
I recently changed my company and got approved for H1 transfer. My wife is on H4. Her 3years H4 was extended with my 3years of H1 extension with the old company.
When I transfered to a new company her visa was not transfered as she is dependant on H1 and did not have to be...
You are right, but...
The EB2 or EB3 classification is made depending on the job requirement not the individual qualification.
In the job ad it says that the job requires Bachelor+5 years but will accept MS+3 in lieu of BS+5 but MS+3 is not the primary requirement. Do you think this...
Hello all Gurus,
Now here is my situation, following is the job ad that was posted for the PERM.
Here is the job advertisement:
"Bachelor degree (Computer Science, MIS or related).
Experience (concurrent): 5 years (will accept Master Degree in Computer Science, MIS or related and 3 years)...
Very helpful, but confused.
I had two years of experience before I joined my current employer. I am in fourth year of my H1. So I have more than 5 years of progressive experience after my undergraduate.
I guess I am a little confused. Is it safe to use experience with the same company?
On...
Correct
That is absolutely correct but you can use your experience with the same employer if you are not in the same position and your job dutues are substantially different, i.e. more than 50% different, from your previous job.
In my new/current job my job duties have changed more than 50%...
Thats good
Thanks for the reply, I appreciate that.
I agained most of my experience with the same company under a Programmer Analyst designation. Now I am working as a Sr. Programmer and my job duties have changed more than 50%. The experience in the advertised job will be very close to my...

Appreciate all the help
Thanks everybody for your responses.
I have more than 5 years experience and I am working as a Sr. Prog. Analyst but my company’s lawyer thinks its excessive to ask for BS+5 and guarantees that the case will be denied or at least it will be audited. My company is...
it needs to be more than 50% different
You can use your experience with the current employer if you can prove that the job responsibilities and duties after the promotion are substantially more than 50% different from your duties before promotion.
Thanks for the response.
Does that mean that one cannot file LC for EB2 if the requirements do not ask for Masters and only require BS+5?
Company I work for do not require MS for Sr. Systems Analyst/Sr. Programmer Analyst but only require BS+5, so I think if I put BS+5 as requirements it...
Hello,
I have recently found out that there are LCs being rejected based on the fact that the job requirements were Bachelor + 5 years for a Senior Programmer Analyst.
My lawyer told me that there have been some filing of PERM (by other lawyers) where the job requirements were BS+5 years...
Well I may be wrong here but my understanding is when you change your company either after PERM or after I-140 approval you wil have to refile PERM and I-140 with the new company as the PERM is company specific and I-140 is approved on the basis of PERM so both PERM and I-140 are inter-linked...
Go for it
As far as my understanding goes the EB2 requires BS+5 or MS+0 as the minimum requirements. If your friend's job does require BS+5 or MS then you DO NOT need to include the experience he/she gained at the current employer, it is not needed. And why would you want to include the...
