I don't think the salary really matters as long it is not below poverty line and you end up being a public liability. As long you have a job and as long you are not working at McDonald's, I think you are OK. As long you are in your profession, you are safe.
Why?
Why do you NOT want to file AC21?
I don't think it is going to effect your case in anyway. If you want a new attorney, you will have to file a G28 Form(If I remember correctly).
If you have already paid this attorney for the whole process, ask for a refund.
I don't think salary is really a big factor. As long you don't work at McDonald's while GC is being sponsored for a Programmer, you are OK. All they really care is that you should be making enough as not to become a public liability and be in the same or similiar filed so to honor your labor...
Sorry for the confusion. I meant the other way. You should be clean after your last entry into US. 245(k) covers you automatically if the status violation is less than 180 days.
I think you are fine. Since you went out of the country and came back with a fresh visa. They usually check your legal status since your last entry into US.
But they could still raise a question that may need to be handled by a good lawyer.
The important question here is did this happen...
Where in the world do you guys have time for this...
Between this job and the family, I hardly find time to even watch a TV show, leave alone writing an application that does nothing but increase frustration due to the BCIS's speed.
I just could'nt stop myself, so I am posting this quote...
