Someone else suggested that I should speak with the Consul rather then the embassy workers. I was advised to wait until after the interview. The Consul usually don't take kindly to Embassy workers (Visa/passport) abusing their powers. Thanks everyone for great advice.

The embassy would have accepted the EAD card. How is EAD card makes you any different then a b1/b2. You are still on same status because EAD holder is also waiting for GC.

i don't know. i assume if you goto india, you get your passport renewed there. i also assume INS accepts expired passports. i do know someone higher up at the embassy so let's see what happens at the interview.

Don't worry about it. As long as you can show that you and your spouse is leaving together and has been together since marriage then you should have no problems. You can show shared health insurance, joint bank statements, car insurance, you can add your name to telephone, gas and electricity...

Well, I wasted another day at the Indian Embassy. No passport reissue unless we have the GC or letter that GC has been ordered.

My mom is not planning on traveling anytime soon so I am OK with I-551 stamp that is for 2days. We will wait for the GC.

Time for me to make another trip to the Embassy.

The passport will still be valid on the day of the interview. Her passport expire on July 31th and her interview is on July 30th.
