One of EB1-A requirements is: beneficiary must be shown to be an individual who is one of that small percentage who have risen to the very top of the field of endeavor.
I believe that it is foolish to mention any specific percentage in a recommendation letter. Specifically, if it will be 5% -...
It looks like that 485 based on 140-OR can be approved wthout interview.
Many EB-1A and NIW cases get transferred to a local office. Look at local NY thread for more information. Backlog there is enormous.
My case was transferred to Baltimore in February 2004 and I received plastic card...
Be aware that to switch to EAD you would need about two months window. First, you will have to wait for I-485 receipt, then it may take about 30 days or more to receive an EAD.
During this time you would have to have a current visa to get paid.
If your H1b visa expires soon, then you have...
red020,
Your situation is too complicated. For I-140 approval there should be no big obstacles. Some people even go away without claiming AC-21 at all.
But this definitely will be an issue at the interview stage. Again, as I can see from the postings on this forum, in some cases you will...
I did use EAD to work for a company. In February 2003 I had a job offer from a government agency. That agency refused to deal with my EAD and wanted either H1b visa or permanent residency. I called to INS and they told me that the only way for me to get a new H1b was to recall my immigrant...
You became out of status only if visa has expired and 485 is denied.
If you always renew O-1 (or any) visa on time, then there is no reason to worry.
It is allowed to renew non-immigrant visas while your immigrant petition is being processed.
I think that at I-140 stage you do not need a waiver. You may search this forum or internet to confirm that.
It is absolutely necessary for 485. Without a waiver you are not eligible for adjustment of status. If you applied concurrently, then this could be a serious problem.

I think it would not hurt to file an affidevit. I did not submit it with I-485 application but was asked to fill the affidevit form for my wife and son at the time of interview.
It is all over for my wife too.
She just got her plastic card today. It happened 2 weeks after we went to Baltimore, asked to review her case and she was approved.
Good luck to everyone.
Finally, got my wife's case approved.
We made a trip to Baltimore today. Arrived at 8:50. Took a number. Waited for 2.5 hours. Officer was very difficult and did not want to do anything about my wife's case. The interview was on May 18th, imminization record was screwed up by a doctor. I have...
Felipe/Lydia,
Do you remember what was the day of the week you visited Baltimore and they told you that you would not be serviced without an appointment?
