DV 2025 AOS (Adjustment of Status) Process Only

in the previous communication with kcc, they enquired about my derivatives and their dv payments
But they still don’t have a case file to send to the embassy. All they have is your intention to do AOS. And anything to do with you was sent to USCIS for your adjustment case. So they literally don’t have anything to send to the embassy.

Just to give you little about my background

Am DV2025 winner while residing in USA and my DV based AOS Filed on October 2024 . Had my interview on February 2025

Over the past 10 months, I have made multiple efforts to communicate the time sensitive nature of my case through letters, phone calls to the USCIS Contact Center, in person visits,and a congressional inquiry. Unfortunately, each request for expedited processing has been denied, with responses indicating that my case would be processed in its regular order. I also submitted an expedite request based on my wife’s serious medical condition, which was likewise denied.


As just said Already had my interview on February 2025 at USCIS and now they are sending me the attached notice saying “ Interview Cancelled And Notice Ordered



On September 24, 2025, we cancelled your interview for your Form I-485, Application to Register Permanent Residence . “




Any help will be appreciated. I only have 6 days to deadline for DV2025 now

This is probably a glitch in the system, or someone clicked on the wrong update button. Nonetheless, I recommend you try another walk-in attempt at your FO, you should be able to get better clarification (if allowed in, or allowed to speak with someone). You can also reach out to your congressperson requesting their assistance with getting clarification on your case update.

Today i was in FO, the security guy didn’t allow me to talk with supervisor, but allow drop the letter. Woman on the reception window posted the stamp on my copy “received”. How you think, they really give this letter to supervisor/director/officer ? Thank you!

That is what I have been doing for almost three times now . But I am not receiving anything specific they just give generic reply which is not fair at all especially when the deadline is right here . I wish you all the best
 
@Sm1smom let's say that my wife is the one who is stuck in the background check. Could we advise the USCIS to approve my application if her background check does not clear on time? I understand this would basically make her immediately out of status, with a grace period to leave lawfully I believe. After she leaves we would then initiate a normal green card spouse application. Have people done this before in this situation?

I understand this would basically make her immediately out of status, with a grace period to leave lawfully I believe. After she leaves we would then initiate a normal green card spouse application. Have people done this before in this situation?
In such situation, I believe they can/do use their discretion by approving the primary applicant. If that happens, yes a derivative (who has no individual fall back status of their own) will need to depart from the US while a spousal application gets initiated for them. I hope it doesn't come down to that for you guys.

Thanks. By that do you mean that they even do that by default without consulting us? Or would that be after finding a way to advise them to do that?

I was never a lawyer but thanks to @Sm1smom (Dr DV-AOS ) @Britsimon (Dr DV-CP) and the rest of you all the members of this AOS journey family, I almost Successfully completed my DV AOS …..approval update notice shown on my USCIS account waiting for the mail and card production …..I said almost cause unless I got it on hand I can’t say it is all done yet

Now am about to start my FTJ process only have 5 days but I will try with GOD all things are possible


I will keeep you posted

By default, since both cases are technically speaking separate cases, even though approval of derivative is conditioned on the primary applicant's case approval.

Congratulations. Just like I guessed the previous update about your interview being cancelled was a glitch.

You’re aware your wife would have to wait outside the country for the process to complete - she would not be able to AOS because of being out of status, even for one day.

There is afaik no “grace period to leave lawfully”. There is no ban on re-entry until she has accumulated 180 days of unlawful presence, but that’s different. Once she has been out of status she also normally can only get a nonimmigrant visa in her home country or country of residence.

All in all yes there’s a plan B but really hope it doesn’t come to that as your current situation means it is not as easy as it might be for some others.

Got it, that's surprising to me. So if neither of us are approved by Tuesday would that be safe to assume that either I was stuck in background check or both of us and not just my wife? Like, your expectation would actually be that they would approve the primary applicant as long as they were themselves in the clear?

Yes we're aware of that. A plan could be to live near the Canadian border so she can stay there while I continue to maintain my status in the US and that I'm able to see her and my son regularly.

However with what you said:

That makes me question that? I'm unsure of exactly what that entails. Does that just mean she must apply to the consulate in her home country but doesn't necessarily need to be living in her home country?

If she had to stay in her home country for the entire period, that would be very difficult indeed.

If she had to stay in her home country for the entire period, that would be very difficult indeed.
The US does not dictate where she has to live, only where she can apply for a visa. If she can prove residence in a 3rd country she can apply there, however realistically having been out of status once before and awaiting a green card likely means getting a visit visa is not going to happen.

So with doing a walk in tomorrow, do you think I should bring my wife and son again like last time? Or would it be logistically better to just go solo? The reason being my son is only 2 and can be a handful and get bored so I could imagine they wouldn't want us hanging around without an appointment. We did bring him last time though.

The only reason would be in-case they wanted to do an interview immediately and needed everyone there but I'd imagine that's unlikely at this point. I don't think they are intending to have an interview.
 
Today my attorney received a call from uscis officer who was my interviewer, and she said that we my wife and i should come again tomorrow. Didn’t tell what we should to bring or what reason for interview again. What can be the reason? I gonna take all documents with me again just in case anyway. Thank you
