DV 2025 AOS (Adjustment of Status) Process Only

I had my interview yesterday. I would describe it as polite and uneventful. Went through the usual sign-in process. After some pleasantries, IO asked for 4 things: current passport with F-1 stamp, old passport with J-1 visa stamp, most current university transcript, and original birth certificate. We went over a few yes/no questions. No other issues or complications were raised. She wrapped it up by indicating all she has to do is check for visa availability or something, and I should see an update in my USCIS account within 10 days. I take this as good news and am checking my account daily for any updates!

There’s an expectation to be able to demonstrate you’re not likely to become a public charge, a W2 is one of the ways for doing so. Do you have some other financial documents for demonstrating financial self sufficiency?
like paystubs?
 
One of my friends did AOS recently and said it is no longer necessary to include Tax returns. USCIS will check on that through IRS.
Did the IO that interviewed your friend specifically tell him that is what they do, or your friend came to that conclusion because they did not include the IRS tax transcript with their AOS package and there was no issue with that? AFAIK, USCIS does not operate as described by your friend.

i stand corrected but i do not believe USCIS has the authority to request individual taxpayer information from the IRS. ( The recent agreement with ICE is with ICE only for people with removal orders and/or under criminal investigation.) I would also note that USCIS does not know whether or not you submitted returns independently of what you include in your package. Many adjustees do not in fact need to pay tax. I doubt they would waste time requesting taxppayer records for everyone “just in case”, even if they could.

Should I also include explanations regarding the approved PERM or other supporting documentation, or is it sufficient to simply submit the I-797 since USCIS may already have the prior records on file?
2. I didn’t update my address on the SEVP website immediately when I moved a few years ago, I updated it about a year and a half after relocating. Could this pose any issues in my case?

1. An explanation is not necessary (IMO).
2. Should be fine as long as your SEVIS was never terminated.

I contacted congresswoman and she opened the case to USCIS agency for my DV. The USCIS replied me through congresswoman that SF FO has scheduled for an interview on July 22. They sent that email on July 3 Thursday. It has not updated on my USCIS portal and also when I asked to EMMA, the live agent said my interview has not scheduled yet.
1. Is it normal? I understand that last weekend was a long weekend.
2. How long do they take to reflect on my account?

You're fortunate to have been able to obtain this update through your congresswoman's office. It is quite normal to not see a status update online regarding the scheduled interview, or for a live agent to be able to provide you with the information, as the FOs more often than not do not provide online case status updates for DV based AOS applications. The standard practice is to see the IL in your mailbox when the USPS delivers the mail, (unless you have informed mail delivery services in place, in which case you might see an incoming mail from USCIS prior to it getting delivered in your mailbox).

My case number is current and I have a valid non-immigrant status, but the I539 extension for my dependents is still pending (filed separately at the end of January 2025, prior to status expiring in March 2025). During an online chat with the Emma agent today the agent indicated that I don't need to wait for the I539 to be approved and can file the I485. Does that sound correct? I'd thought that I'd read otherwise somewhere in these forums (can't find it now though).

2. Just noticed that our I693s are the 03/09/23 edition that is noted to expire on 03/31/2025 (not sure how I messed that up) and they were signed by the civil surgeon on 06/06/2025. Looking at the USCIS guidance it would seem that I can submit this form since it was signed prior to 07/03/2025. Is that correct or am I out of luck since the form was signed after the form expiry of 3/31?

1. Yes that is correct. AOS application can be filed while an EOS or a COS application is pending. The AOS application however will not be adjudicated while the EOS or COS application is pending (that is what you most likely read in this forum and misinterpreted).

2. The expiration date on the I-693 is irrelevant to you. What matters is the edition date on the form, that is what USCIS uses in determining if the correct form is used or not. Per their website:
“EDITION DATE
01/20/25. If the civil surgeon signs your form on or before July 2, 2025, you must use the 03/09/23 or the 01/20/25 edition. If the civil surgeon signs your form July 3, 2025 or later, USCIS will accept only the 01/20/25 edition. You can find the edition date at the bottom of the page on the form and instructions.”
 
"ALERT: The USCIS lockbox facility may reject an application package for various reasons, including lack of payment of the application fee or failing to sign the application. If we reject your application package and return your application package with the Form I-693 envelope opened, and you wish to file a new application package with the original opened Form I-693, you may file the original opened Form I-693 and any supporting documentation that was previously included by the civil surgeon in its original envelope with a copy of the rejection notice."

I just saw this statement on USCIS webpage. AFAIK we had to get a new medical form with sealed envelope after getting a rejection, but now they do not require this anymore. That's a good news, I guess.

That alert has always been there. Being able to re-use an already opened medical report is only applicable if the package rejection was not medical report related.

Was your initial filing rejected due to your your I-693 form not being a currently accepted edition? If yes, then you wouldn't have been eligible to re-file with the same (opened) medical report in that case.

Compared to past reported cases from your FO, I believe your case is within the normal processing time for your FO, and I do not see a basis for initiating a congressional case inquiry at this point, and there’s still enough time left in the FY. However, you may decide on initiating a congressional case inquiry at any point you feel like.
 
We’ll be overnighting the package right back, hoping that this time a more knowledgeable officer reviews it and hoping that they’ll go by the delivery date regarding the July 2nd cuttoff for using the old version of the medical form.

I suppose it doesn’t hurt to try again before going through the hassle of redoing the medicals.

I have a question about cutoff numbers. If my number is included in the cutoff, should I wait until the first of next month to submit or I can submit now? My FO is Texas
