DV 2025 AOS (Adjustment of Status) Process Only

I'm aware the 60/90 day rule is non-binding on USCIS. I came back from international travel a week ago, and since time is running out, I want to submit the AOS package as soon as possible. Have there been previous cases where applicants faced issues after applying soon after entering the country? Particularly F-1 students. Thanks!

Hi Mom,

We sent our applications last week, including the I-693 forms using the prior version that USCIS is only accepting until this Wednesday (July 2nd). The package shows as delivered, but we haven’t received the SMS or email confirming receipt yet.

Can you please clarify whether USCIS goes by the date the package is delivered or the date it is opened and processed when determining if the correct version of the form was submitted before the cutoff?

Here’s the exact wording from the website which indicates it is about when the case is officially accepted as properly filed:

“Starting July 3, 2025, USCIS will accept only the 01/20/25 edition.”

Anyway, you’ll just have to wait and see at this point.

I recommend you take a look at some of the past Timeline spreadsheets in order to get an idea of the average processing time for the two referenced FO. Also, bear in mind, other factors can influence how quickly a particular case gets adjudicated, and not just the FO itself.

Bear in mind if you file with your Maryland address and subsequently move to DC (if your new address falls under a different FO), the move can further delay your case adjudication.

We're starting to get worried there might be something wrong with our embassy (Dublin), so we wanted to check what you think about moving to AOS at this time. We were thinking of giving it another week or so to get an interview scheduled and if not, move to AOS and start the AOS process.

My question is, how late would you feel comfortable switching to AOS in this situation? As per my understanding, even with early filing, they won't start processing the documents until August, so whether we file prior to August or on August 1st, it doesn't make a huge impact on our situation. My understanding is that we can ask KCC to switch to AOS any time before our interview has been scheduled and we can start sending our packet pretty much immediately upon receipt confirmation of the KCC switching us to AOS.

I'm sorry I honestly can't help you decide on when to pull the plug and switch over to AOS (or not), this is a call you'll need to make on your own. I probably wouldn't have been in the same situation in the first place, so I can't advise on how late I would feel comfortable before switching over to AOS. I however can tell you the longer you wait, the more difficulty it might be to successfully make the switch because once the KCC sends over your case file to your applicable embassy (even if the interview has not yet been scheduled), KCC will no longer be able to switch your case over to AOS. You will have to work directly with the embassy to get your KCC file transferred to the FO that will have jurisdiction over your AOS application in that case.

It seems to me that your understanding of the AOS process is rather flawed. It is not true that even with early filing USCIS will not start processing your documents before the month in which your CN becomes current. USCIS will begin processing the application as soon as the AOS package is received. Final case adjudication is what will not happen prior to the month in which the CN is current. I recommend you spend some quality time going over the AOS process spreadsheet if you are seriously considering a switch over to ensure you have a good understanding of the steps involved with the process.

KCC is not known to provide direct response or clear guidance on questions asked. You might want to safe yourself the headache of receiving a convoluted response from the re wanting them to clarify the process of changing from CP to AOS.

Did you email Dublin? Hopefully they respond timeously.

CEAC status *does* indicate whether KCC sent your file to an embassy (and At NVC means they have not). Until that happens embassy knows nothing of you and that'll be their response should you send them an email.
 
In 2023, I filed my taxes using TurboTax, not realizing it was intended for U.S. residents. As a result, I received an education credit, which is reflected on my IRS Tax Return Transcript for 2023. Since amending a tax return takes several weeks, should I just include the transcript as is in my AOS package?

Right, which BritSimon was saying would likely be because Dublin has not asked to schedule DV cases yet for some reason and they won't send them until Dublin will take them...unless it's just that KCC is taking time to get them all transferred over for some reason?

Yes you can do that. Just make sure you handprint the form legibly.

Yes — we’re planning to do early filing to make sure it’s in before July 3rd. Really hoping the package gets accepted, because if it's rejected, we’ll need to redo the medicals, which would be a hassle.

We’ll definitely include an early filing cover letter, as you recommend in the spreadsheet. Out of curiosity, have you come across any cases where USCIS rejected an early filing even with a cover letter?

Was the rejection due to early filing and have you already received back the rejected packages?
