Change of status from B2 To TN without I94

Hi,

I am currently in the US on B2 and would like to change my status to TN using i129 instead of going to the border. I entered the US without I94 since most canadians do not get I94s entering as a tourist. Can I still apply for change of status using the I129 with no i94?

Yes. You simply enter "NA" for the I-94. You still need to enter your last entry date and port of entry and current status. Just no I-94. USCIS is aware that the vast majority of Cdns enter in undocumented B-2 status.

My immigration lawyer said it was not possible with no i94. Do you know how I can confirm that this is indeed possible?

Doing it will confirm that it is possible. Most immigration lawyers are woefully clueless when it comes to the Canadian wrinkles to US immigration law.
 
Your lawyer is quite clueless. I hope you are not paying him.
