Hi,

My fiance lives in the US, we're 3 months into our application to get me a visa so I can go over there and get married.

Thing is, in 4 months of looking for work she hasn't had so much as an interview and I myself work frelance and don't earn enough to support us both.

How is it viewed if I have to return to the UK to afford to live? and will her not having any income by the time the visa is due to be issued affect whether I even get approved?

Thanks

K-1 expects that the couple, after getting married, will live in the US.
If she is unemployed when your K-1 interview comes along, she will need a financial co-sponsor.

How is it viewed if I have to return to the UK to afford to live? and will her not having any income by the time the visa is due to be issued affect whether I even get approved?

Thanks for the reply.

Would a parent suffice as a sponsor? In terms of providing housing and such.

You appear to be taking the wrong course of action from the start. She can go to the UK and marry you and she can petition for you as a spouse later when the time is right to actually make the move to the U.S.

well, we've already applied and are 3 months into the process. Plus we've spend hundreds so far and the job prospects for her over here are much worse.

so, would a parent qualify as a sponsor?

The K-1 fiance is allowed to enter and marry within 90 days (you can do it faster but most states have a waiting period of at least a few days).

Then you file for adjustment of status along with a bunch of additional forms and evidence. One of those forms will be for "advance parole" or AP.

AP must be obtained before you may depart abroad or else the adjustment is denied as abandoned and you can't come back until you get an immigrant visa.

It may take anywhere from 2 to 4 months just to get the AP and then you will eventually be interviewed for the greencard. The process can take anywhere from 4 to 8 months on average. Usually at least 6 months.
