Hello everyone,

Its been a while since I last posted. I however have been - on and off - reading people's posts.


My asylum was approved on 27th of August 2010 by the IJ. Today is August 6th. I was kind of wondering when is the soonest I can / am eligible to apply for my GC. Like, does it have to be EXACTLY after a year or could i do it it few days sooner?

Any inputs would really be appreciated. Assylum, have you applied for your i-485 yet?

Please advise!

If you file even ONE DAY early it MUST be denied or rejected. The problem may be that it could be accidentally accepted early and they won't catch the mistake you won't get denied until you show up for the interview. Just wait.

Thanks for your prompt response. It really make sense. I think I'd just add extra days to my 350 days of waiting to make it 365 per requirement. But, I'm kind of confused with what you said above "until you show up for the interview" part. Do I anticipate to be called for an interview?

Most I-485s other than employment-based do get an interview. It is possible that an asylee who has filed an I-485 AND who has absolutely "no issues" that mandate an interview might be granted without an interview. In that case, a denial would just come in the mail but it still would waste a bunch of time.

Majority of the asylees get their I-485 approved without an interview. Infact interviews are pretty rare.
 
Thanks guys. Appreciate your responses. Based on what I have heard from the fellow asylees I know, they were never called in for an interview. But certainly, I have read about those "rare" people who actually had to go through one.. or may be two. I think it will be even more "rare" to actually be declined for a GC without any "substantial issues".

I'm excited to be on my voyage to the GC, will keep you guys posted! Million thanks!

Is it one year from the grant of asylum date to the GC application receipt date (filing date) or one year from the grant of asylum to the date you sign on the GC application?

For example if the grant of asylum was on August 27,2010 and the applicant signed the GC application on August 25,11 and was mailed on August 28 and the receipt date is August 30,2011. Will it be rejected/denied because the signature date was 2 days earlier?

USCIS will assign the filing date as the day they receive it with proper signature and correct fee. It can be rejected for either of those reasons. In addition, when a check bounces, that will push back the filing date until the check clears. (They will only try up to 2 times to redeposit a check and then reject.) What I have described is what USCIS calls "properly filed".
