N-400 & Travel out of country

Hi Everyone,

I will be completing 5 years on May 9, 2011. I'm planning to apply for N-400 after Feb 15, 2011. When I count the number of days between Feb 15, 2011 and May 9, 2011, it is less than 85 days, so that should not cause any problems in regards to the 90 day rule.

But the problem is, I'm planning to travel out of the country in June/July 2011. How long does it take to receive FP notice after applying for N-400? I believe that depends on the local USCIS District Office, which in my case is Washington DC (Fairfax DO).

I remember reading in one of the threads that USCIS may not start processing an application until 5 yrs are completed, even if we apply 90 days before. Is that true? If so, should I expect to receive the FP notice when I'm out of the country?

Bottomline, I'm trying to plan my travel so that I'm not out of country when I receive communications from USCIS that need to be acted upon.

The "delay" you COULD encounter is not in the beginning of the N-400 processing but rather at the end of the processing. In those few cases the situation was the fast processing that resulted in a person reaching the interview in less than 3 months and therefore, the officers would not grant the N-400 and schedule for oath until after the entire 5 years was completed.

Review the posts and see how long the folks who applied in your same area had to wait for a FP notice. 3 to 6 weeks, perhaps?

If you are filing Feb 15, you will be extremely unlucky to get your interview as late as June. If worst does happen, you do have the option to reschedule or do a walk-in FP.
The case starts processing as soon as you file, no 90 / 85 day wait.
I do not know about your DO, but you should hope to complete interview before your travel. And unless you have same day oath, you can tell the officer to schedule the oath after your return.

San Jose, do you have some information on the OP's DO that's not visible on this thread? While my N-400 was in process this year I was active in maintaining and studying the tracker spreadsheet. It's abundantly clear from the numbers provided by people that the elapsed time between filing and interview depends very much on the DO, and is very little affected by early walk-in FP, if at all.

I filed in mid April of this year and my interview was in mid August. My DO was Atlanta, and this was not an unusual wait for an interview in Atlanta, at the time. There were lots of Newark filers on the forum here in April, and they had very consistent elapsed times of 4.4 months from N-400 receipt to interview date. If the OP is in Atlanta or Newark, and processing times haven't changed lately at those DOs, he or she would be very likely to get an interview in late June.

The problem is, processing times do change. This makes prediction of one's likely interview date unreliable. All you can do is try to estimate based on facts (recent processing times at the same DO) and decide for yourself how much interruption or postponement of travel plans is appropriate and tolerable. No I do not. I do not have numbers specific to DOs ready.
OP always has the option of rescheduling the interview. Even if interview did not happen in 4.4 months, I am sure he will know in that much time when the interview is, and plan a reschedule.

On another note, my son is 13 yrs. old. From what I understand, it is the same process for him as well. Is that correct?

If your 13 yr old has a greencard and lives with you he should automatically get citizenship via INA 320. He can get a passport and can get a certificate through a form N-600.

Thanks. I'm assuming this means he does not have to go through the N-400 process along with us. We need to submit an N-600. Is that correct?
