what visa to apply for the get the gf ova the the usa

just need some thoughts or idea from ppl that may have been throught a similar process

i entered the us on a dv lottery visa from australia 2 mths ago. started a relationship pretty much after i applied. we are trying to get the misses over aswell. if we had to get married while she was over here we would do that as we have been together 2 1/2 yrs. maybe a student or work visa to buy us time? what would she need to do to qualify for either? we are tryin to get her here perminantly. what would u guys suggest. we are goin to see an immigration lawyer when she gets here via the vpw but trying to sus things out in advance
 
So you are GC holder and got married after you entered the US with your immigrant visa? If that is the case, your wife has to wait it outside the US unless she can get an H-1B/L-1 visa.

yes green card but not married. whats usually the wait time b4 that visa is approved once maried? and also how bout a student visa? whats the code for a student visa as i dont think she qualifies for the above listed

Realistically 4 to 5 years. Student visa is a possibility but not a very promising one. Having a spouse/fiance' in the US who is a citizen or a GC holder, makes it difficult to qualify for a student visa in most cases.

i was thinking gettin her a student visa b4 we got married. wow 4-5 yrs! talk about sensitivity from the us government. someone else said something about being an illegal immigrant and after 5 od years they give u a visa anyways as long as u have been self suffient and not gotten into trouble but that doesnt sound smart anyways???
 
You both are engaged. She will need to mention you on her DS-156 even if not married.
There is a right way or doing things and a wrong way. No one on this forum will suggest you to listen to what "someone" told you.

we arent engaged i was just sayin we are a couple and would get married if it made it easier for her to stay or speed the process up. thanks for your feedback already tho

It's just a matter of numbers. There aren't enough visas available in this category to meet demand, therefore it takes several years for you to get to the front of the line.

It's not very smart, because no such provision exists.

Unfortunately, if your girlfriend cannot get an H or L visa, you need to wait. Getting married will at least start the wait, but nothing more.
 
can they still travel here twice a yr on 90 day visa via the vpw or will that not be allowable due to the fact they think she may overstay
 
so what does the usa government expect partners to be seperated for 4-5 yrs b4 they can reunite? very od policy. i kno theres a huge prob with illegal immigrants but thats a bit rediculous isnt it?
 
its sounding like the only way is to have her come ova on 2 x tourist visas each each via the vpw and just apply every year for the dv lottery?? talk about living on hope!

I agree that the quota is probably too low, but the US doesn't expect partners to be separated. If you were married when you applied for the DV lottery your spouse could have immigrated with you.
 
yes i relise that. its just when i first applied we were only together for 3 mths so i was expecting us to even be together let alone moving to another country together.

No not at all! US government doesn't say you HAVE to stay in the US. You can go back and live with your partners - if that is more important to you.
