A senator is a congressperson..just like a representative is a congressperson.
 
yeah i think so too but i decided to go to the congressman first then go for Lisa Murkowski maybe next week. i just want to try first and see how things are gonna go with the congressman. i already filled up one of those privacy act release papers and sent it to my congressman through fax earlier today. if things dont go well then i'll go for the senator next. i was thinking of sending both the congressman and the senator the privacy act release papers earlier today but i decided not to do it in the same time and give the congressman time and see if he'll put some work on it.

You don't actually have to go to their offices in person. The Congress is in session and members of Congress are likely to be in Washington.
Most of them have an online form for submitting constituent requests (or you can send it by regular mail); privacy act consent forms could be faxed.
But if you really want to go in person, that's fine too. Most likely you'll get to talk to a staffer.
 
just to let some people know i received a letter from congressman dong young about my issue with the uscis. his letters says that he already contacted officials from uscis and he will let me know when those officials responds back. im really hoping that he could help me on this one.

Good. I am sure that, at the very least, the congressman's office will be given correct factual info by the USCIS, and you'll know what really has been going on with your application.
 
ok... i faxed a privacy act release form last week to congressman don young... i got a letter from him that says that he already contacted uscis and will let me know when uscis responds back to him. today i received another fingerprint appointment from uscis. it says that my fingerprint card on file with the uscis already expired and i have to do it again. is this normal? it has been over a year since i did my fingerprints (did my fingerprints march or april 2009). does fingerprint files really expire? im glad that somehow i got a letter from uscis but im not sure if this is actually good news for me. what do you guys think?

Yes, the second FP appointment is both normal and necessary in such cases (see my signature for my own timeline, as an example). The FP results expire after a year and need to be redone before a case can be approved. It is standard procedure.

The fact that you got the second FP notice is actually a good sign, and is some indication that you case may have started moving.

(correct me if im wrong about the background checks with the fbi) but i was told before by a uscis costumer service agent that i was already in a queue or a waiting list to get an interview appointment (i was put in the waiting list in january 2010). if im already in the waiting list to get an interview appointment already, then why do i still need to do another fingerprint appointment. they're not gonna put me on a waiting list to get an interview appointment if my name didn't clear with the fbi right? now im thinking uscis is just playing with me and they're giving me wrong info. i think this is bs and someone please clear me if im wrong.

It may not make much logical sense (in fact it does not), but that is the standard USCIS protocol in cases where a fingerprint check is over 1 year old. My understanding is that the 2nd FP involves only the fingerprint check (which is usually done in one day), but not another Name Check. basically they send the fingerprints to he FBI, which runs them through their fingerprint database to see if they come up in any FBI criminal cases. The results are usually returned to USCIS within a day, even within hours (compared with name check which often takes months or even years). Basically, this is used to verify that there have been no criminal convictions/arrests of the applicant during the year that passed since the first fingerprinting check.

It still does not make sense for them to have to drag you to the second fingerprinting appointment (it's not as if someone's fingerprints change their shape in one year). Presumably they keep the scanned fingerprints of an applicant in their computer from the 1-st FP appointment, so they could just send those to the FBI for another quick run through their database. For some reason, however, that's not how USCIS does things.

Until about 1.5 years ago, FBI Name Check often used to take forever, often more than a year. In such cases a second FP appointment was always necessary and these cases were very routine. If you go back to the posts in this forum in 2007-2008, you'll see lots of such posts there.

Sometimes a naturalization interview gets scheduled before the 2nd FP appointment takes place but where the first FP was over a year ago. But in such cases they have to defer the actual approval of the application until the second FP check is done.
 
USCIS only stores FP results for 15 months. Once that timeframe expires, a new FP notice is sent to the applicant. Since the OP is already in queue for interview, his checks have already been cleared, but new FPs are required in order to schedule the interview.
