what is the time frame for visa when upgrading for F2 to IR1 after spouse becomes USC

Hi all...can anyone help me with this issue that has been playing around with my mind...my spouse will be USC around first week of march...since my I-130 is already approved few weeks back, when my spouse upgrades our case.from F2 to IR1...how long does it take for NVC to approve or rather issue a visa number? Answers will be very much appreciated.

Are you in the States? if yes, send I-485, with a cover letter, a copy of I-130 notice of approval, a copy of spouse's naturalization certificate and supporting documentation to the lockbox in Chicago.

If not in the States, upgrade the petition. How long it takes depends on the USCIS.
 
Hi LucyMo...Thanks alot for ur prompt reply. Yes I was aware that if I am in the states///its I485 ..if I was there ..maybe I wouldnt hav been much worried. Unfortunately I am not there so which means I have to wait for USCIS to work on my papers...Do you have any clue how long it takes to get it processed from the USCIS? Thank you once again.

MY I 130 was approved couple of weeks back. my priority date is september 2006 and currently they are processing the priority date of march 2006 and on march they will be working for the priority date of april 2006. BAsed on this, calculating with the rough estimation, I hav about 6 months before they get to my priority date. IS it wise to upgrade my case since I have read that upgrading can be more time consuming at times.
What should I do? KIndly help.

You cannot enter as spouse of LPR when your spouse is a citizen. He must upgrade the information with NVC, no way around it except he does not take oath until after you get your GC. It makes it quicker for a spouse(I know that, because my spouse was F2A waiting for visa number and got the GC in 2.5 months via I-485) but slower if you have minor kids on the original I-130. They would require a new I-130 for every child. Once he becomes a US citizen a visa number will be immediately available for you. You will possible get called for the interview before the PD would be current depending on which country you live in. So when he upgrades the petition to IR1 the process will start moving quickly so you should get the IV in 4-10 months.

Since the I-130 has already been approved and at the NVC, they will send him a letter soon with a case number but for F2A category.

Please make a copy of your Naturalization Certificate. Send the copy - NOT the original - to the NVC with a letter containing the beneficiary name and case number of the petition you want to upgrade.

Depending on which country the time frame differs, 4-10 months after upgrade is reasonable to get the immigrant visa.
