Question About K-1 and B-2 Visas

While vacationing in Lithuania in the summer of 2007, I met a wonderful lady. We corresponded periodically for about 6 months, then quite regularly since. She is a Doctor and a citizen of Ukraine. She currently has both a Shengen Visa and a US B-2 visa. Over the 1 1/2 years, she has visited me in the US 5 times, and I have visited her in the Ukraine twice. On my last visit in July, I ask her to marry me.

We plan to file for a K-1 visa this month. Before we do, we need to know if she can continue to use her b-2 visa while we applying for the k-1. She has a child and currently has shared custody with her ex-husband. Given her custody arrangement, she wants to make sure she can still visit the US for periods of a month or less until the K-1 visa is granted.

Any advice is greatly appreciated

She can continue to use her B-2 visas while the K-1 is in process. Just beware that entry may be denied at the POE.

Why don't you bring her here on B-2 with her child and marry her here? The process is easier.

I hope that you forgot to add 'and then they return back to their own country and apply for a spousal visa'. To enter the US on a tourist visa with the intent to stay and adjust status is visa fraud...........to give advise about this being the route the OP should take is extremely wreckless.

That is true, but they are coming to visit him. Right? That is what I understood...:) Her intention is to visit and go home. Who knows what may happen once she's here...

She would be coming for 3 months and then returning home. I do not intend for her to stay until we are approved for the k-1 Visa. My concern is that she could be denied entry because we were in the process of applying for the k-1.
