Interview with an arrest

^ I have the original disposition papers(2 copies of it) i hope they serve as certified. Just curious did they ever asked you for disposition papers??

Do they have the official stamp?.....They might ask you for it, I've seen cases on here where the IO asks for them saying they don't have them even when the person sent it with the N-400, don't know why! They should have everything you send! I find this stupid since they have a SUPER background check with all this information....UGH! they just want to make people sweat hehe.

Ginnu,

You should disclose this arrest on your visa application.
-----------------Why I should disclose arrest on my visa application? I dont have any arrerst and I am NOT applying any Visa for any country??? I never posted that I am applying for Visa or any application. My reply was to OP. questions.

They don't have any certification stamps on it as they are original papers issued by the court its say defendants copy on the upper corner

Let me chime in and it might help you or maybe not. My friend who has arrests dated back in the 1998 and then in 2000 applied for the HIB visa in '07 he took the risk of not adding those arrest on his application. When the BG check was done nothing came up they only pulled info from past 5yr as i recall. In the end he got his visa
I'm not advising you to lie but just stating an experience of a close friend of mine.

On OF156 form there is a question :"Have you been arrested or convicted"?
If you answer No but when you should answer Yes, then what will you do in
the future when you file for I485 and N400? You will still say No to be consistent?

I heard to some IOs certified court documents must have a raised seal.
The USCIS also instruct court documents must be very eligble and clearly writtem but local police officers, court clerks and judges do not care about that and just write charge, disposition etc in a very reckless manner

The visa application does not include FP check or name check but I485 and N400 do. So depend whether the applicant was fingerprinted or not

No there was a name check for H1 stamp but they only ran it for last 5yrs i believe. I'm not sure about the finger printing part i want to say yes.

they are machine typed and also has some manual corrections(strike thru the dismissed charges) which is readable. Hopefully it works out.

Done! with on the spot approval

Interview was @ 11am i was little nervous about the whole thing.....after taking 2 wrong exits i finally reached the place @ 11:05 there was one person infront of me he got called in 5-6mins and then this other dude who came after me got in b4 me .
I was sitting there for little over 30mins when i got called in. So the officer introduced him self (i didn't quite get his name) went into his office. I was told to put my stuff on the table and remain standing.....did the whole bit about telling the truth nothing but the truth......sat down. Then he asked me for my Passport (Expired) driving license (which is from different state) and GC.He examined all three identies. He then explained me that i was going to be quizzed on civic test 1st then proceed to the application etc (me = BRING IT ON !)
The questions asked were:
- Name one state bordering Canada
- When was constitution written
- What age can you join the selective services
- How many senators are there
- Ocean on the east coast
- One reason for the civil war

We proceeded to the writing part i was told to write "We Pay Taxes" .....he told me i passed the civic part (awesome!)

Next he went thru the application and asked me the same questions which were on the application my name, my dob, address whether those were correct etc. i asked him for some corrections on the app such as i wanted to apply based on 5yr not 3yr and other minor things. He did ask me when i got married and what was my wife's dob.
Now to the good part (arrest questions)
I said Yes to the "Have i ever been arrested" so he asked me what happened i explained him and kept it short and sweet. So just to be Clear NO ADDITIONAL PAPERS were requested NO DISPOSITION or NO CERTIFIED COPIES other than the one mentioned in the very 1st post(which was sent with the application) BUT he did see that i had driving on the wrong direction ticket mentioned in the application so we wanted to know whether i took care of the fines. Good thing (my recommendation) i had all the original receipts when i paid my fine. I handed all of them to him he made a copies and was surprised that i kept them in my records xD
So he proceeded with the rest of the questions checked each of them with a red pen and towards the end he told me to sign at 3 different places plus on the edge of my pics.
He then pulled out a form (N-652) and said that u passed the English test and put a X infront of the first statement and then put another "X" infront of another statement and i could see the words "Congratulations!" then i looked up at him he said i'm recommending you for approval...woohooo....DONE! he told me expect a letter in 2 weeks...

Congratulations..so you were initially charged with prostitution solicitation eventhough it was your friend who did all the talking and you were only the driver?

You were late, so they had the right to make you wait! That guy might have had an 11:15 appointment, so it wouldn't have been right to make him wait until after you, if he was early for his interview and you were late for yours (even though he showed up after you).

Anyway, congrats!

Congratulations!!!

I handed all of them to him he made a copies and was surprised that i kept them in my records

If he was suprised then I guess he did not expect anyone to keep suchg record and would have not requested for it if you just had told him
you paid teh fine and had no record

Actually i offered the receipts when he asked me why i drove on the wrong direction. After the explanation i told him the fine has been paid off and here are the original receipts

By the way, did you feel your IO had examined if you also disclosed the incident on old immigration benefit application like I485 since the incident was in 2000 and your got your GC in 2003?

That is true

That prostitute must have been looking at your big guns...:D Hence, the officer charged you with this crime of looking hot...

Congratulations!!! Once you are a citizen, feel free to explore the world. However, night ladies should be avoided at all costs, even if it hurts..:)

Congrats!

I noticed that you and wong from San Francisco had almost the SAME questions asked on the interview.....crazy.
